How much notice is needed to not renew a lease in Saudi Arabia?

Short answer

A lease in Saudi Arabia renews automatically unless one party tells the other, at least 60 days before it ends, that they do not want to renew; this applies in every city to leases longer than 3 months. In the Riyadh urban area, a lessor may refuse a renewal the tenant wants only on specific grounds. Where the reason is that the lessor wants the residential property for personal use or for a first-degree relative, the Real Estate General Authority (REGA) has raised the lessor’s notice to at least 365 days; its decision names no city, and Ejar presents the rule as part of the Riyadh conditions.

The 60-day rule in every city

The regulatory provisions governing the relationship between lessors and tenants, issued by Royal Decree M/73 dated 2/4/1447H, made automatic renewal the general rule in Item Eight: a lease renews unless one party notifies the other at least 60 days before it ends that they do not wish to renew. Item Eight sets two exceptions: fixed-term leases that had 90 days or less left when the provisions took effect, and leases that both parties agree to end by mutual consent after the notice deadline has passed.

Outside Riyadh, both the tenant and the lessor may decline to renew without conditions, provided they respect the notice period.

The 365-day notice for personal use

Paragraph 2 of Item Eight allows REGA to extend the notice period in model contracts in line with the lease’s term and type. On that basis, REGA’s chief executive decided on 2/7/1447H (December 2025) that in model residential leases a lessor’s non-renewal notice must be at least 365 days before the lease ends when the lessor wants to vacate the property for personal use or for use by a first-degree relative.

A further decision dated 7/9/1447H applied this period to all residential leases in force when the provisions took effect, and provided that if the 365 days are not met before the lease ends, the lease renews for as long as needed to complete them, counted from the date the non-renewal notice was given.

Neither decision names a city. Ejar, however, presents the 365-day notice as one of the non-renewal conditions that bind lessors in Riyadh, and says that elsewhere both parties may cancel auto-renewal without conditions by giving notice 60 days before the end.

What is different in Riyadh

In the Riyadh urban area, a lessor may not refuse a renewal the tenant wants, even with timely notice, except in specific cases. This restriction applies for 5 years from the provisions’ entry into force on 25 September 2025, and a breach carries a fine of up to 12 months’ total rent. The cases are:

  • The tenant has failed to pay.
  • Structural defects affecting the safety of the property and its occupants, confirmed by a technical report approved by the competent government body.
  • The lessor wants the residential property for personal use or for a first-degree relative.
  • Other cases set by REGA’s board of directors.

Follow-up questions

How do I send a non-renewal notice on Ejar?

Auto-renewal is on by default in new leases, and you give notice by cancelling it in your Ejar account before the 60-day window begins: under Contracts, view all contracts, open the three-dot menu next to the lease and choose “Cancel auto-renewal”. All parties are notified by text message.

I missed the 60-day deadline. Will the lease definitely renew?

If notice is not given in time, the lease renews automatically. However, the provisions exclude leases that both parties agree to end by mutual consent after the deadline; on Ejar this is done through a termination request filed by one party and approved by the other.

Does a tenant’s refusal of a rent change end the lease?

If the lessor submits a rent-adjustment request on Ejar at least 90 days before the lease ends and the tenant rejects it, or does not respond before the 60-day window begins, auto-renewal is cancelled and the lease ends on its end date. In Riyadh, only requests to lower the rent are allowed.

What if the tenant stays after the lease has lawfully ended?

Article 435 of the Civil Transactions Law makes the tenant liable for the equivalent market rent, without prejudice to the lessor’s right to compensation. The lessor can file an execution request with the Execution Court via Najiz, because a lease documented on Ejar is an executive instrument; the current Execution Law (M/53) applies until 27 October 2026 and the new law (M/237) from 28 October 2026.
