Short Definition

VAT on real estate services is the standard 15% VAT charged by a registered supplier on property-related services, such as sale and letting brokerage commissions, property-management and rent-collection fees, valuation, surveying, design and maintenance.

Overview

VAT on real estate services is the standard 15% VAT charged by a registered supplier on property-related services, such as sale and letting brokerage commissions, property-management and rent-collection fees, valuation, surveying, design and maintenance. It is added to the price of the service and borne by the client, then remitted by the supplier to ZATCA; it is not an amount deducted from the broker's commission. The VAT Implementing Regulations treat the services of estate agents, auctioneers, architects, surveyors and engineers, and construction and maintenance work, as real estate related services whose place of supply follows the location of the property: a service relating to property in the Kingdom is taxable there even if the client is non-resident, while a service relating to property abroad is not treated as relating to real estate in the Kingdom. Crucially, the exemptions for residential rent and property sales do not extend to these services: a broker letting an exempt residential flat charges 15% on the commission, a property manager charges 15% on fees even when the rents collected are exempt residential rents, and a broker on a property sale (VAT-exempt and subject to the 5% Real Estate Transaction Tax) charges 15% on the commission. Only a registered supplier charges VAT, and registration is mandatory once taxable supplies exceed, or are expected to exceed, SAR 375,000 over 12 months. A non-registered broker may not issue a tax invoice or collect VAT; doing so is a violation fined up to SAR 100,000. Registered suppliers must issue FATOORA-compliant e-invoices, and a registered client using the service in a taxable activity can deduct the VAT, whereas for an owner of exempt residential rentals it becomes a cost. The brokerage or management contract should state expressly whether fees are VAT-inclusive or VAT is added on top.

Legal Basis

Real estate services are subject to the VAT Law issued by Royal Decree No. (M/113) dated 2/11/1438H at the standard 15% rate in force since 1 July 2020; the Implementing Regulations define real estate related services (including estate agents' services) and the registration thresholds (SAR 375,000 and SAR 187,500). Article 44 of the Law fines a non-registered person who issues a tax invoice up to SAR 100,000. Brokerage activity itself is governed by the Real Estate Brokerage Law issued by Royal Decree No. (M/130) dated 30/11/1443H and supervised by the Real Estate General Authority (REGA).

Practical Example

A registered brokerage office in Khobar lets a residential flat for SAR 50,000 a year for an agreed commission of SAR 2,500. The rent itself is exempt, but the commission is taxable: 2,500 × 15% = SAR 375, so the client pays SAR 2,875, the office issues an e-invoice and remits SAR 375 to ZATCA. The office also manages a residential building earning SAR 600,000 a year for a 7% fee (SAR 42,000) plus SAR 6,300 VAT = SAR 48,300; because the owner's income is exempt residential rent, he cannot deduct the SAR 6,300, which becomes a cost. Had the building been commercial and the owner registered, he could deduct it in his return. Had the office deducted the VAT from its commission instead of adding it, it would have unintentionally borne 15% out of its own income.

Common Mistakes

  • ✗Deducting VAT from the commission instead of adding it — the office then bears 15% out of its income; VAT should be added to the fee unless the fee is agreed to be VAT-inclusive.
  • ✗Assuming commission on letting an exempt residential flat is exempt too — the commission is a separate service taxed at 15%.
  • ✗Charging VAT or issuing a tax invoice before registering — a violation fined up to SAR 100,000.
  • ✗Not stating in the brokerage or management contract whether fees are VAT-inclusive or exclusive — a frequent cause of disputes.
  • ✗Treating a service to a non-resident client as a zero-rated export although the property is in the Kingdom — the place of supply follows the property's location.

International Differences

Brokerage and property-management services are subject to indirect tax in most VAT countries, even when the lease or sale itself is exempt. In the UAE, broker commissions are taxed at 5%, and in Turkey real estate brokerage services bear KDV at the standard 20% rate. EU countries generally follow the rule that the place of supply of real estate related services is where the property is located, the same rule applied in the GCC. The Saudi context stands out for its 15% rate, relatively high for the region, mandatory e-invoicing linked to ZATCA's systems, and the requirement of a REGA-issued Fal licence to practise brokerage at all.

FAQs

Is a real estate broker's commission subject to VAT in Saudi Arabia?▾
Yes. Brokerage commission is taxed at 15% if the broker is VAT-registered; the VAT is added to the commission and paid by the client, and the broker issues an electronic tax invoice.
Is commission on letting a residential flat taxable even though the rent is exempt?▾
Yes. The residential exemption covers the rent itself and does not extend to the brokerage service, so the commission is taxed at 15% when charged by a registered broker.
Are property-management fees subject to VAT?▾
Yes. Property-management and rent-collection fees are taxed at 15% even when the rents collected are exempt residential rents; the owner can deduct the VAT only if registered and using the service for taxable supplies.
Must every individual real estate broker charge VAT?▾
No. Only registered brokers charge VAT, and registration is mandatory once taxable supplies exceed SAR 375,000 over 12 months. An unregistered broker may not collect VAT or issue a tax invoice.
If the client lives outside Saudi Arabia, is the brokerage service exempt?▾
Not if the property is in the Kingdom. The place of supply of real estate related services is where the property is located, so the service is taxed at 15% in Saudi Arabia wherever the client lives.
