Short Definition

A townhouse is a single-family house of two or more storeys built in a row of similar attached houses that share side walls, each with its own external entrance and often a small private yard or garden.

Overview

A townhouse is a single-family house of two or more storeys built in a row of similar attached houses that share side walls, each with its own external entrance and often a small private yard or garden. Townhouses usually sit between apartments and detached villas in size and price, but that is a market pattern rather than part of the definition; the defining feature is being attached side by side in a row while keeping a separate entrance and ownership. They are common in new master-planned residential projects and compounds in Saudi cities, often with shared facilities such as gardens, pools, parking and security. A townhouse has no legal category of its own; its position depends on how it is owned. It may stand on a separate plot with its own title deed, or be a sorted unit within a residential complex governed by the Law of Ownership, Sorting and Management of Real Estate Units (Royal Decree M/85 dated 2/7/1441H). In the second case, the side walls between two adjoining units are jointly owned by their owners unless there is a structural separation (Art. 7); the owners must form an owners' association once there are three or more of them and register it with the Real Estate General Authority (REGA) (Art. 12), whose statute sets the rules for owners' contributions to management and maintenance of the common parts; and a "complex association" bringing together representatives of the jointly owned properties in a real-estate complex may be formed (Art. 13). The seller must give the buyer a disclosure statement on the unit, the common parts and their management; if material information is missing, the buyer may rescind within 30 days (Art. 6). Off-plan sales fall under the Off-Plan Sale and Lease of Real Estate Projects Law (Royal Decree M/44 dated 10/3/1445H) and REGA's Wafi platform: the reservation amount during marketing may not exceed 5% of the unit value, and the owners' association is registered from the start of handover of the second unit. In practice, buying a townhouse attracts the 5% Real Estate Transaction Tax instead of VAT, with the Ministry bearing the tax on up to SAR 1,000,000 of an eligible citizen's first home, and ownership costs include a periodic service charge set by the owners' association for the common parts. A residential lease is documented on Ejar for SAR 125 per contract year with no VAT. Before buying, check whether the yard and parking space belong to the unit or are common parts, and read the complex's internal rules on alterations and facades.

Legal Basis

A townhouse sorted within a residential complex is governed by the Law of Ownership, Sorting and Management of Real Estate Units, Royal Decree M/85 dated 2/7/1441H (disclosure statement and 30-day rescission right - Art. 6; shared walls - Art. 7; owners' association - Art. 12; complex association - Art. 13), supervised by the Real Estate General Authority (REGA). Off-plan sales are governed by the Off-Plan Sale and Lease of Real Estate Projects Law, Royal Decree M/44 dated 10/3/1445H, through the Wafi platform; sales attract the 5% tax under the Real Estate Transaction Tax Law, Royal Decree M/84 dated 19/3/1446H; and residential leases are documented on the Ejar network.

Practical Example

A Saudi employee reserves an off-plan townhouse worth SAR 1,200,000 in a Wafi-licensed project in Jeddah. The maximum reservation during marketing is 5% x 1,200,000 = SAR 60,000, and his payments go into the project's escrow account, not the developer's own account. On transfer of ownership RETT is 5% x 1,200,000 = SAR 60,000; as it is his first home and he is eligible, the Ministry bears SAR 50,000 and SAR 10,000 remains. After handover he pays an annual owners' association contribution (for example SAR 6,000) for the gardens, pool and security, and checks the disclosure statement to confirm that the two parking spaces attached to the unit are allocated to him and are not common parts.

Common Mistakes

  • ✗Confusing a townhouse with a detached villa - a townhouse is usually attached on both sides, and the dividing walls may be jointly owned with the neighbour rather than private.
  • ✗Ignoring owners' association contributions when calculating ownership cost or rental yield, although they are a recurring obligation in sorted complexes.
  • ✗Paying a reservation above 5% of the unit value during marketing, or paying for an off-plan project that is not licensed on Wafi or outside its escrow account.
  • ✗Assuming the yard, parking space and roof belong to the unit without checking the title deed, disclosure statement and sorting document.
  • ✗Altering the facade or building in the yard without a permit or regard to the complex's rules - affecting facades is prohibited in jointly owned property.

International Differences

The townhouse is an international form under different names: the "terraced house" in Britain and the "row house" or "townhome" in North America, where many are run by homeowners' associations that levy periodic fees. In the UAE and Egypt townhouses are common in gated compounds alongside the "twin house" attached on one side only, and in Turkey the equivalent is the attached-order house, with units in complexes following the condominium (floor ownership) rules. The Saudi specific is that sorted units fall under the Unit Ownership Law, with owners' associations registered with REGA.

FAQs

What is the difference between a townhouse and a villa?▾
A detached villa stands on its own plot separate from its neighbours, while a townhouse sits in an attached row and shares side walls with its neighbours while keeping its own entrance. Its plot area and setbacks are therefore usually smaller.
Does a townhouse owner get a separate title deed?▾
Usually yes: either the townhouse stands on its own plot with its own deed, or it is a sorted unit in a complex that receives its own deed under the Unit Ownership Law. In the latter case the owner also holds an undivided share of the common parts attached to the unit.
Do townhouse owners have to pay owners' association fees?▾
If the townhouse is a sorted unit in a jointly owned property with three or more owners, an owners' association must be formed and its statute sets the owners' contributions for management and maintenance of the common parts. Owning a unit counts as accepting the statute and the general assembly's decisions.
What is the maximum reservation for an off-plan townhouse?▾
In projects under the off-plan sales law and the Wafi platform, the reservation amount during marketing may not exceed 5% of the unit value. Payments are deposited into the project's dedicated escrow account.
Is buying a townhouse subject to VAT?▾
No. Property sales have been outside VAT since 4 October 2020 and instead attract the 5% Real Estate Transaction Tax. The Ministry bears the tax on up to SAR 1,000,000 of an eligible citizen's first home.
