Short Definition
An apartment is a self-contained residential unit within a multi-unit or multi-storey building, with its own entrance and one or more rooms, a kitchen and bathrooms, sharing common parts such as the land, entrances, stairs, lifts, parking and tanks with the other units.
Overview
Legal Basis
Apartment ownership is governed by the Law of Ownership, Subdivision and Management of Real Estate Units issued by Royal Decree No. (M/85) dated 2/7/1441H (Article 2: subdivision and a deed per unit; Article 4: REGA approval of subdivision; Article 6: disclosure statement and 30-day rescission right; Article 9: no harm to structure or façades; Article 12: owners' association at three or more owners) and by the Real Estate Registration Law issued by Royal Decree No. (M/91) dated 19/9/1443H. Purchases fall under the RETT Law (M/84) dated 19/3/1446H, and off-plan purchases under the Off-Plan Sale and Lease of Real Estate Projects Law (M/44) dated 10/3/1445H.
Practical Example
Faisal bought a 160 m² apartment in a subdivided building in Riyadh for SAR 850,000 as his first home. The 5% transaction tax amounts to SAR 42,500, and because the price is below SAR 1,000,000, the state bore it in full once a first-home certificate was issued through Sakani. Faisal received a separate deed for the apartment, and before buying he reviewed the disclosure statement, which allocated him one basement parking space and a roof storeroom. The building has 12 owners and an owners' association registered with REGA, to which he pays SAR 3,600 a year for lift maintenance, cleaning and security. When he wanted to glaze in his balcony, he checked the association's statute first, because the law bars any alteration affecting the façades outside the approved rules.
Common Mistakes
- ✗Buying an apartment in an unsubdivided building without its own deed, or under a contract that does not establish ownership of a specific unit — weakening legal protection and complicating mortgages, financing and resale.
- ✗Ignoring owners' association contributions and decisions — owning a unit in a building with an association counts as accepting its statute and the decisions of its general assembly.
- ✗Making alterations that affect the structure or façades, such as removing a load-bearing wall or changing a balcony's appearance — which the Real Estate Units Law prohibits.
- ✗Paying a reservation deposit for an off-plan apartment outside the escrow account or for a project not licensed on Wafi — even though a reservation during marketing may not exceed 5% of the unit value.
- ✗Not checking the disclosure statement on parking, storerooms and roof rights — the points on which many later neighbour disputes turn.
International Differences
Separate ownership of apartments within a shared building is a globally familiar system known as strata title or condominium ownership, regulated differently from country to country. In the UAE, emirates such as Dubai regulate jointly owned property and owners' associations with periodic service charges; in Turkey, the Condominium Law (Kat Mülkiyeti Kanunu) governs independent units, common parts and building management; in Egypt, many apartments still change hands under unregistered contracts. In Saudi Arabia, the Real Estate Units Law combines a separate deed for each apartment, a mandatory owners' association at three or more owners and a rescission right where disclosure is incomplete.
