Overview
Residential property is any real estate designed and licensed for the permanent housing of individuals and families, such as apartments, villas, duplexes, studios and detached houses; its status comes from the use approved in the plan and building permit, not merely from people living in it. In the Saudi Building Code (SBC 201) it corresponds to the Residential occupancy group (R), while offices, shops and warehouses fall under other occupancy groups.
In Saudi Arabia this classification has direct legal and financial consequences. Leasing residential property is exempt from VAT under Article 30 of the VAT Implementing Regulations, unless the property is a hotel, serviced accommodation or a building designed for the temporary stay of visitors. The lease is documented on the Ejar platform supervised by the Real Estate General Authority (REGA) for a fee of SAR 125 per contract year, and a documented unified residential lease is an executive instrument. A sale carries no VAT but the 5% Real Estate Transaction Tax (RETT), and the state bears the tax for an eligible citizen on up to SAR 1,000,000 of the value of a first home. Where a building is subdivided into units held by three or more owners, the Law of Ownership, Subdivision and Management of Real Estate Units applies and an owners' association must be formed. In Riyadh, annual rent increases for residential and commercial property are frozen for five years from 25 September 2025.
In practice, the residential label defines what the owner may do with the property: municipal office requirements confine offices to sites designated for commercial or mixed use, renting to tourists by the night requires a permit from the Ministry of Tourism, and in mixed-use buildings the exempt residential rent must be separated from shop rent, which is taxed at 15%. Any decision to buy, let or change use should therefore start by checking the approved use in the title deed and building permit.
⚖️ Legal Basis
Residential property rests on the Saudi Building Code Application Law issued by Royal Decree No. (M/43) dated 26/4/1438H, under which residential buildings fall in occupancy group R; the VAT Law issued by Royal Decree No. (M/113) dated 2/11/1438H and Article 30 of its Implementing Regulations, which exempt residential leases; the Real Estate Transaction Tax Law issued by Royal Decree No. (M/84) dated 19/3/1446H (5%); the Law of Ownership, Subdivision and Management of Real Estate Units issued by Royal Decree No. (M/85) dated 2/7/1441H; and the lease provisions of the Civil Transactions Law issued by Royal Decree No. (M/191) dated 29/11/1444H. Leases are documented on the Ejar platform under REGA's supervision.
💡 Practical Example
Saad owns a mixed-use building in a Riyadh neighbourhood: a ground-floor shop let to a restaurant for SAR 60,000 a year, with six apartments above let at SAR 48,000 a year each. Saad is VAT-registered because his taxable supplies exceed the threshold, so he adds 15% only to the shop rent (SAR 9,000), bringing it to SAR 69,000, while he adds no VAT to the apartment rents because they are exempt residential leases. He documents the shop lease on Ejar for SAR 200 for the first year and each apartment lease for SAR 125 per year. At renewal in 2026 he wanted to raise the apartment rents by 10%, but Riyadh's five-year freeze on annual rent increases from 25 September 2025 prevents this, so he renewed at the same rent.
⚠️ Common Mistakes
- ✗Assuming any property people live in is legally residential — what counts is the use approved in the plan and building permit, not how it is actually used.
- ✗Adding 15% VAT to apartment or villa rent — residential leases are exempt; hotels, serviced accommodation and temporary visitor lodging are what is taxed.
- ✗Leaving a residential lease undocumented on Ejar — under Council of Ministers Resolution No. (292) of 1438H an unregistered lease produces no administrative or judicial effect.
- ✗Turning an apartment into an office or letting it nightly to tourists without a licence — offices are licensed in commercial or mixed-use locations, and tourist rentals need a Ministry of Tourism permit.
- ✗Confusing VAT with the Real Estate Transaction Tax on a sale — selling residential property attracts 5% RETT, not VAT.
🌍 International Differences
The residential versus non-residential distinction exists in most markets, but its consequences differ. In Gulf states that apply VAT, residential rent generally receives lighter tax treatment than commercial rent, and the UAE regulates lease registration through local systems in each emirate. In Turkey, the Code of Obligations contains special rules for leases of dwellings and roofed workplaces that protect tenants. In Egypt, old contracts under exceptional rent laws still differ from newer contracts governed by the Civil Code. Saudi Arabia stands out for linking the tax exemption, mandatory electronic documentation and executive force in a single system through the Ejar platform.
FAQs
Is residential rent subject to VAT in Saudi Arabia?▾
No. Leasing residential property is exempt under Article 30 of the VAT Implementing Regulations. Hotels, serviced apartments and buildings designed for the temporary stay of visitors are excluded from the exemption and taxed at 15%.
How much does Ejar charge to document a residential lease?▾
The documentation fee for a residential lease is SAR 125 per contract year. The lease renews automatically unless either party sends a non-renewal notice at least 60 days before it ends.
What tax is due when buying residential property in Saudi Arabia?▾
The Real Estate Transaction Tax of 5% of the transaction value applies, and no VAT is charged on the sale. For an eligible citizen, the state bears the tax on up to SAR 1,000,000 of the value of a first home under the Sakani programme's conditions.
Can residential property be converted to commercial use?▾
Not by the owner's decision alone: the approved plan and local building rules must allow the new use and the municipal approvals and licences must be issued. In a subdivided jointly owned building, the Real Estate Units Law also requires the owners' general assembly to approve a change of use.
Is a residential lease an executive instrument?▾
Yes. A unified residential lease documented on Ejar is an executive instrument that can be taken directly to the Execution Court without a full lawsuit. The new Execution Law issued by Royal Decree (M/237) dated 3/11/1447H is expected to take effect around late October 2026.
