Short Definition
Property management is the handling of a property's financial and administrative affairs on behalf of its owner or the holder of its usufruct, including leasing units, collecting rent, overseeing maintenance, managing tenant relations and accounting to the owner, in return for an agreed fee.
Overview
Legal Basis
The Real Estate Brokerage Law, issued by Royal Decree No. M/130 dated 30/11/1443H, defines property management as handling a property's financial and administrative affairs on behalf of its owner or usufruct holder; its Article 4 prohibits providing real estate services without a REGA licence, and its fines reach SAR 200,000. Article 2 of its implementing regulation restricts property management services to licensed establishments. The manager's relationship with the owner is governed by the agency provisions of the Civil Transactions Law (Royal Decree M/191 dated 29/11/1444H), and the relationship with tenants by the lease provisions of the same law and the rules of the REGA-supervised Ejar platform.
Practical Example
Sarah owns a 12-apartment building in Al-Narjis, Riyadh, with each flat let at SAR 60,000 a year, and hires a licensed property management establishment for 7% of rent collected. At full occupancy annual rent is SAR 720,000, so the fee is SAR 50,400, plus 15% VAT (SAR 7,560) because the establishment is VAT-registered, while the residential rent itself stays exempt. The establishment documents the leases on Ejar (SAR 125 per residential contract year) and transfers net collections to Sarah monthly with a statement. Because the building is in Riyadh, the manager cannot raise any flat's rent at renewal during the freeze, so the job centres on cutting vacancy and speeding up maintenance rather than raising prices.
Common Mistakes
- ✗Hiring an individual or an unlicensed entity to manage the property — the implementing regulation restricts this service to establishments holding a Fal Property Management Licence.
- ✗Confusing property management (financial and administrative affairs) with facility management (technical affairs) — each has its own licence and scope of responsibility.
- ✗Mixing owners' money with the office's own funds — the law treats money an agent collects for the principal as a deposit, so it must be kept separate and accounted for regularly.
- ✗Relying on a verbal arrangement without defining authority, fees and a maintenance spending cap — the source of most owner-manager disputes.
- ✗Ignoring the Riyadh rules and trying to raise rent at renewal or on a change of tenant — a violation whose fine can reach 12 months' rent of the unit.
International Differences
Property management is regulated to varying degrees in most markets. In Dubai it is carried out by licensed brokerage and management firms, with leases registered in the Ejari system. In Turkey real estate brokerage requires an official authorisation certificate, and jointly owned buildings are usually run by a manager chosen by the owners under the Condominium Law. In Anglo-Saxon markets a broker licence or professional membership and segregated client-money accounts are often required. What sets Saudi Arabia apart is that the definition and the licence sit in a single law, the service is limited to establishments, and documentation and collection are tied to the government Ejar platform.
