Short Definition
An online auction is a real estate auction in which bids and the award are handled on an electronic platform instead of, or alongside, an auction hall; Saudi law treats it as a real estate auction that only REGA-licensed establishments may run.
Overview
Legal Basis
Article 1 of the Real Estate Brokerage Law, issued by Royal Decree No. (M/130) dated 30/11/1443H, provides that real estate auctions include electronic auctions. Article 2 of REGA's Real Estate Auctions Regulation (REGA Board decision of 1/12/1444H) sets the licensing conditions for establishments running auctions electronically (link to REGA's platform, integrity of operations, data publication, necessary licences, and Nafath connection); Article 3(3) requires auction proceedings to be video-recorded and kept for five years; and Article 8(10) lists a live-stream link among the bulletin's contents. Article 62 of the new Execution Law, issued by Royal Decree No. (M/237) dated 3/11/1447H, requires execution decisions and procedures to be carried out through approved electronic means.
Practical Example
Saeed works in Riyadh and wants to buy a residential plot in Qassim. He finds an online auction listed on REGA's platform for a plot appraised at SAR 480,000, asks a relative to inspect it, then registers via Nafath and pays a SAR 24,000 entry amount (5%). On auction day he follows the live stream and raises his bid to SAR 515,000; the award period and the single extension pass without a higher bid, and the plot is awarded to him. He pays the SAR 491,000 balance within the set period, plus 2.5% commission (SAR 12,875), VAT on it (SAR 1,931.25) and the Real Estate Transaction Tax (SAR 25,750), without travelling.
Common Mistakes
- ✗Bidding without inspecting the property, relying on photos — the platform is no substitute for inspection, and hidden defects are not warranted in judicial sales.
- ✗Waiting until the final seconds to bid without remembering that only one extension is allowed.
- ✗Registering on a platform not linked to Nafath and REGA's platform — a sign it is not licensed.
- ✗Ignoring verification messages and payment deadlines sent by the platform after the award.
- ✗Assuming the auction is cancelled if the bidder's connection drops — the platform's obligation concerns its own technical errors, not the bidder's circumstances.
International Differences
Real estate auctions have moved online in many countries. In Turkey, enforcement auctions became electronic through the e-Satış portal within UYAP. In the United States, private platforms for bank-owned properties and timed auctions are widespread. In the UAE, auction companies run judicial and voluntary sales through electronic apps. The Saudi model is distinctive in the mandatory link between every private platform, REGA's register and Nafath, and in requiring video recordings to be kept for five years.
