Short Definition
An auction platform is an electronic environment in which real estate auctions are announced, bids are submitted and awards are managed; in Saudi Arabia such platforms operate only under a REGA licence and with mandatory links to REGA's electronic platform and to the national Nafath login service.
Overview
Legal Basis
Article 2 of REGA's Real Estate Auctions Regulation (REGA Board decision of 1/12/1444H) sets the licensing conditions for electronic platforms: connection to REGA's platform, guaranteed integrity of operations with the power to halt or rerun an auction affected by errors or violations, publication of auction data, and connection to Nafath. Article 5 establishes the Real Estate Auctions Register on REGA's platform, and Article 3 requires licensees to keep bulletins, records and video recordings for five years. This rests on the Real Estate Brokerage Law (M/130), whose definition of real estate auctions includes electronic auctions and which requires a licence (Arts. 1 and 4). Court-referred assets are offered through the Support and Liquidation Center (Infath), established by Council of Ministers Resolution No. (415) dated 19/7/1440H and organizationally linked to the Minister of Justice; its tasks include selling assets, liquidating estates and engaging specialized firms (Art. 3 of its Organization).
Practical Example
A Dammam company wants to sell a warehouse appraised at SAR 3,500,000 by online auction. It engages a licensed establishment whose auction platform is linked to REGA's platform and to Nafath. The establishment files the auction request with REGA at least 15 days ahead; once approved, it lists the bulletin on REGA's platform and then publishes it five days before the auction. Sixty bidders from several cities register, each paying an entry amount of SAR 100,000 (below the 5% cap of SAR 175,000). Bidding ends at SAR 3,720,000; the establishment closes the auction on REGA's platform within five working days, refunds the 59 unsuccessful bidders within three working days and keeps the video recording for five years.
Common Mistakes
- ✗Bidding on a platform that is unlicensed or not linked to REGA's platform — payments made there have no regulatory protection.
- ✗Transferring entry amounts to a personal account at the request of a social-media «organizer» — licensed platforms must specify how bidders' funds are held in the auction request.
- ✗Confusing REGA's platform (register and oversight) with the licensed establishments' platforms on which bidding actually takes place.
- ✗Assuming a technical glitch automatically cancels the award — the establishment must halt or rerun an auction affected by technical errors, under REGA oversight.
- ✗Ignoring the auction bulletin listed on REGA's platform and relying only on marketing adverts.
International Differences
Real estate auction platforms exist worldwide in different models. In Turkey, state enforcement auctions run on the e-Satış portal within the UYAP judicial system. In the UAE, private and semi-government auction companies operate electronic platforms for judicial and voluntary sales. In the United States, private platforms are widely used to sell bank-owned properties. The Saudi model is distinctive: platforms are privately operated but must be linked to a single government register at REGA and to Nafath identity, with periodic auction statistics published.
