Short Definition

A duplex is a single residential unit spread over two consecutive floors connected by its own internal staircase, sold or leased as one unit even though its floor area sits on two levels.

Overview

A duplex is a single residential unit spread over two consecutive floors connected by its own internal staircase, sold or leased as one unit even though its floor area sits on two levels. Living and reception areas are usually on the lower level and bedrooms on the upper one; being larger than an ordinary apartment is common but is not part of the definition. In the Saudi market the word covers two different things: a two-level apartment inside a multi-unit building, and a "duplex villa" - a two-storey house that often shares a party wall with a neighbouring unit (semi-detached) and may have a roof annex (mulhaq). Saudi law has no separate legal category called "duplex"; what matters is the unit's legal status. If it is part of a jointly owned building, the Law of Ownership, Sorting and Management of Real Estate Units (Royal Decree M/85 dated 2/7/1441H) applies: each sorted unit may have its own title deed, the owners must form an owners' association once there are three or more of them, no owner may carry out work that harms the structure or affects the facades (Art. 9), and floors and ceilings between two adjoining units are jointly owned by their owners unless there is a structural separation (Art. 7). Joining two stacked flats with an internal staircase therefore needs a municipal permit, general-assembly approval of the re-sorting (Art. 3) and approval of the new sorting by the Real Estate General Authority (REGA). Developers may also build attached duplex villas on one plot and sort them into separately deeded units, which brings the party wall and shared parts under the same law; a duplex villa on its own plot follows the local building regulations and the building permit issued through the Balady platform. In practice, a duplex sale attracts the 5% Real Estate Transaction Tax (RETT Law, Royal Decree M/84 dated 19/3/1446H) instead of VAT, and for an eligible citizen's first home the Ministry bears the tax on up to SAR 1,000,000 of the value through Sakani. A residential lease is documented on the Ejar network for SAR 125 per contract year, is exempt from VAT and, once documented, is an executive instrument enforceable at the Execution Court. Buyers should check that the internal staircase and any roof annex appear in the building permit and occupancy certificate, and that the advertised area matches the title deed and sorting document rather than a marketing figure.

Legal Basis

There is no duplex-specific law; the rules follow the type of ownership and use: the Law of Ownership, Sorting and Management of Real Estate Units, Royal Decree M/85 dated 2/7/1441H (a deed per sorted unit - Art. 2; re-sorting and change of use with general-assembly approval - Art. 3; common parts and dividing walls, floors and ceilings - Art. 7; no harm to the structure or facades - Art. 9; owners' association once there are three or more owners - Art. 12); the Real Estate Transaction Tax Law, Royal Decree M/84 dated 19/3/1446H (5%); Council of Ministers Resolution 292 dated 16/5/1438H, under which residential leases not documented on the REGA-supervised Ejar network have no judicial or administrative effect; and building permits and occupancy certificates issued through the Balady platform of the Ministry of Municipalities and Housing.

Practical Example

A Saudi family buys a "duplex villa" that shares a wall with its neighbour in north Riyadh for SAR 1,600,000; it is their first home and they are eligible for support. RETT is 5% x 1,600,000 = SAR 80,000, of which the Ministry bears 5% x 1,000,000 = SAR 50,000, leaving SAR 30,000 of tax. Before the transfer the family checks the deed area and the sorting document against the actual building, confirms that the roof annex appears in the building permit, and that the shared wall is described in the sorting document. If they later let the duplex for SAR 65,000 a year on a two-year contract, Ejar documentation costs 125 x 2 = SAR 250 with no VAT, and the annual rent cannot be raised during Riyadh's five-year freeze that started on 25 September 2025.

Common Mistakes

  • ✗Assuming every "duplex" is a flat inside a building - in Saudi listings it often means a two-storey villa attached to a neighbour, with a different legal position and costs.
  • ✗Opening a staircase between two stacked flats without a permit or general-assembly approval of the re-sorting - the slab between them is structural, and harming the structure is prohibited by Art. 9 of the Unit Ownership Law.
  • ✗Relying on the marketing area of both levels without checking it against the title deed, the sorting document and the building permit, especially for the roof annex and roof terrace.
  • ✗Leaving the 5% RETT out of the purchase budget, or assuming first-home support covers it in full whatever the price, when it only covers the tax on up to SAR 1,000,000.
  • ✗Letting the duplex on a paper contract outside Ejar - an undocumented residential lease has no judicial or administrative effect and loses the benefit of being an executive instrument.

International Differences

The meaning of "duplex" varies by market: in North America it usually means one building containing two separate dwellings with their own entrances, whereas the Saudi apartment meaning is closer to the British "maisonette", a flat on two floors. In Egypt and the UAE duplexes are common in residential compounds in a sense close to Saudi usage, and in Turkey roof duplexes on the top floors of apartment blocks and garden duplexes on the ground floor are widespread under the condominium (floor ownership) regime. The word should not be assumed to mean the same thing everywhere.

FAQs

What is the difference between a duplex and an ordinary apartment?▾
A duplex is one unit spread over two consecutive floors with its own internal staircase, while an ordinary apartment is on a single level. Legally both are residential units, and the number of levels does not change the type of deed or the lease documentation fee.
Is a "duplex villa" in Saudi Arabia a detached villa?▾
Not necessarily; many duplex villas on the Saudi market share a wall with a neighbouring unit and may have been sorted out of a single plot. The title deed and sorting document show whether the land is separate or part of a jointly owned property with common parts.
Can I join two flats in my building to make a duplex?▾
It is possible if the structure is not harmed and a municipal permit is obtained. Because merging units is a re-sorting of jointly owned property, it also needs the owners' association general-assembly approval, REGA's approval and the mortgagee's consent if there is one.
What tax applies when buying a duplex in Saudi Arabia?▾
Property sales have been outside VAT since 4 October 2020 and instead attract the 5% Real Estate Transaction Tax. For an eligible citizen's first home, the Ministry bears the tax on up to SAR 1,000,000 of the value.
How much does it cost to document a residential duplex lease?▾
Ejar charges SAR 125 per contract year for a residential lease, and residential rent is exempt from VAT. The contract renews automatically unless either party gives notice of non-renewal at least 60 days before it ends.
