Short Definition

Real estate data security is the set of technical and organisational measures that protect property and client data — IDs, leases, payment details and bank accounts — from unauthorised access, leakage, alteration or loss throughout its life cycle, from collection to destruction.

Overview

Real estate data security is the set of technical and organisational measures that protect property and client data — IDs, leases, payment details and bank accounts — from unauthorised access, leakage, alteration or loss throughout its life cycle, from collection to destruction. Saudi Arabia has no law specifically on the security of ‘real estate systems’; instead, the Personal Data Protection Law (PDPL) applies to anyone processing individuals' data and obliges controllers to take the necessary organisational, administrative and technical measures to protect it. Its Implementing Regulation requires notifying the Saudi Data and AI Authority (SDAIA) within 72 hours of becoming aware of a breach and informing affected individuals without undue delay. Fines reach SAR 5,000,000 and may be doubled for repeat violations, and disclosing sensitive data with intent to harm or for personal benefit is punishable by up to two years in prison and/or a fine of up to SAR 3,000,000. The National Cybersecurity Authority's Essential Cybersecurity Controls (ECC-2:2024) are mandatory for government entities and for private entities that own, operate or host critical national infrastructure, and other businesses are encouraged to apply them as best practice. The Anti-Cyber Crime Law criminalises unlawful access to systems and data. In practice, the most common incidents at property offices are not sophisticated hacks but unencrypted spreadsheets on laptops, shared passwords and chat groups where ID images circulate. Effective protection starts with collecting less, separating permissions, multi-factor authentication, encryption, and a ready response plan to report within the legal deadline.

Legal Basis

Personal data security is governed by the Personal Data Protection Law issued by Royal Decree No. M/19 dated 9/2/1443H and amended by Royal Decree No. M/148 dated 5/9/1444H, in force since 14 September 2023 and fully enforceable since 14 September 2024, and its Implementing Regulation (72-hour breach notification). The National Cybersecurity Authority issues the Essential Cybersecurity Controls (ECC-2:2024), mandatory for government entities and critical national infrastructure, and the Anti-Cyber Crime Law issued by Royal Decree No. M/17 dated 8/3/1428H criminalises unlawful access.

Practical Example

An employee at a Riyadh office loses a laptop holding an unencrypted spreadsheet with the names, ID numbers and bank accounts (IBANs) of 800 tenants. The office discovers the incident on Sunday morning, notifies the Saudi Data and AI Authority before 72 hours pass, informs the affected tenants and changes passwords. Afterwards it introduces device encryption and multi-factor authentication, deletes unnecessary ID images and limits access to bank data to just two employees.

Common Mistakes

  • ✗Circulating ID and lease images in staff chat groups.
  • ✗Sharing one password for platform and system accounts among all employees.
  • ✗Storing unencrypted client spreadsheets on laptops or external drives.
  • ✗Delaying breach notification beyond the 72-hour deadline while waiting for ‘full certainty’.
  • ✗Collecting more data than needed and keeping it without a defined retention period.

International Differences

The 72-hour breach-notification window mirrors the EU's GDPR; Turkey's Personal Data Protection Law No. 6698 imposes similar duties, the UAE regulates the area through Federal Decree-Law No. 45 of 2021, and Egypt through Law No. 151 of 2020. The Saudi framework combines the Personal Data Protection Law under SDAIA's supervision with detailed cybersecurity controls from the National Cybersecurity Authority that become mandatory depending on the type of entity.
