Short Definition
A tax return is the form a taxpayer files electronically with ZATCA for a specified period, disclosing its sales or revenue, purchases and the tax or zakat due; filing it is the taxpayer's self-assessment of what it owes.
Overview
Legal Basis
The Implementing Regulations of the VAT Law (issued under Royal Decree M/113 dated 2/11/1438H) set the tax periods (monthly above SAR 40 million, quarterly below), the filing and payment deadline (the last day of the following month) and the rules on correcting returns. Article 60 of the Income Tax Law (M/1 dated 15/1/1425H) requires the return within 120 days, and Article 68 requires withholding tax to be paid within the first ten days of the following month. Article 102 of the Implementing Regulations for Zakat Collection requires the zakat return within 120 days of the end of the zakat year.
Practical Example
A Saudi company owns a mixed-use complex in Riyadh; its taxable supplies are below SAR 40 million, so it files quarterly. For July–September: commercial rent SAR 900,000 (output VAT SAR 135,000) and exempt residential rent SAR 600,000, reported in the exempt-supplies box. It paid SAR 30,000 VAT on purchases used only for the commercial part, fully deductible, and SAR 15,000 on shared costs, deductible in the ratio of taxable to total supplies (900,000 / 1,500,000 = 60%), i.e. SAR 9,000. Net VAT due: 135,000 − 30,000 − 9,000 = SAR 96,000, to be filed and paid by 31 October. After its financial year ends on 31 December, it files its zakat return within 120 days.
Common Mistakes
- ✗Assuming filing is enough without paying by the same deadline — late VAT payment attracts a fine of 5% for each month or part of a month.
- ✗Leaving exempt residential rent out of the return — it must be reported in its box because it affects the input VAT recovery ratio.
- ✗Claiming full input VAT despite having exempt income — deduction is limited to costs attributable to taxable supplies, with shared costs apportioned.
- ✗Skipping a return for a period with no activity — a return is required for every period while the taxpayer is registered.
- ✗Postponing correction of a material error to the next return — if the net understatement is SAR 5,000 or more, ZATCA must be notified within 20 days of discovery.
International Differences
Most countries use self-assessment for returns, with the authority entitled to assess. In the UAE, VAT returns are usually quarterly and due within 28 days of the period end. In Turkey, KDV returns are mostly monthly. Saudi Arabia differs in aligning the filing and payment deadlines (the last day of the following month), in collecting Real Estate Transaction Tax per transaction before transfer rather than through a periodic return, and in having a separate zakat return for Saudi-owned businesses alongside the income tax return for foreign-owned shares.
