Short Definition
A tax exemption is a statutory exception that removes a supply, income, transaction or category of taxpayer from a tax that would otherwise apply, so that no tax is charged on it; it exists only where the law or its regulations expressly provide for it.

Legal Basis
Real estate VAT exemptions rest on Article 30 of the Implementing Regulations of the VAT Law issued by Royal Decree No. (M/113) dated 2/11/1438H, as amended by a ZATCA Board resolution dated 14/2/1442H (1 October 2020) to exempt supplies of real estate by transfer of ownership. Real Estate Transaction Tax exemptions rest on its new implementing regulation effective 10 April 2025, and the zakat exemption for public-benefit activities rests on Article 7 of the Implementing Regulations for Zakat Collection (1445H).
Practical Example
An investor in Dammam owns a building with 10 apartments let residentially at SAR 30,000 each (SAR 300,000 a year) and two shops at SAR 90,000 each (SAR 180,000). The apartment rent is exempt, so his taxable supplies are only SAR 180,000, below the SAR 187,500 voluntary registration threshold; he does not register or charge VAT. He then converts 3 apartments into furnished serviced units let by the night, earning SAR 120,000 a year; under the regulations these are no longer residential property, so his taxable supplies rise to SAR 300,000 and he becomes eligible for voluntary registration. Had they reached SAR 375,000, he would have to register and add 15% to the shop and serviced-unit rents, while the other seven apartments' rent stays exempt. This shows how the boundary of the exemption shapes decisions on how a property is operated.
Common Mistakes
- ✗Treating furnished serviced apartments and hotels as exempt housing, although the regulations expressly exclude them from residential property.
- ✗Confusing exemption with zero rating and expecting to recover input VAT on the costs of let housing.
- ✗Believing a property sale is free of all tax, when it bears 5% Real Estate Transaction Tax unless an exemption applies.
- ✗Assuming exemptions are automatic, when some require a step such as a first-home certificate through the Sakani programme or the annual zakat exemption request.
- ✗Exempting commercial rent because the tenant is an individual, when what matters is whether the property is residential, not who the tenant is.
International Differences
Most VAT systems exempt residential rent for social reasons. In the UAE, residential leases are exempt after the first supply, while the first supply of a residential building within three years of completion is zero-rated, and commercial property is taxed at 5%. In Turkey, residential rent let by individuals who are not VAT taxpayers is generally outside VAT, while commercial rent bears the general 20% rate where the landlord is a taxpayer. Saudi Arabia is distinctive in exempting property sales from VAT entirely in exchange for 5% Real Estate Transaction Tax, and in expressly excluding serviced apartments and hotels from exempt housing.
