Legal Basis
Rent discount is based on contractual freedom principle in Civil Transactions Law issued by Royal Decree No. (M/191) of 1444 AH, allowing parties to agree on rental terms by mutual consent, including reduction. Ejar platform provides ability to issue contracts with reduced rent or modify existing contracts. For tax purposes in commercial property, discount must be officially documented to be accepted by ZATCA as revenue reduction, not as gift. During COVID-19 pandemic, government decisions urged discounts for affected tenants, especially in most impacted sectors. Judicial rental committee considers discount-related disputes in case of undocumented agreement.
Practical Example
Owner of commercial complex in Jeddah leases 20 shops at average SAR 80,000 annual rent. In 2026, notices commercial property market in area is competitive, with vacancies in similar complexes. To retain good tenants upon contract renewal, offers discount strategy: 5% discount for tenants with excellent record (never late in 3 years) = SAR 4,000 annual discount, 8 qualified shops. 8% discount for tenants paying full year in advance = SAR 6,400, 5 shops. 3% discount for renewing tenant for second year = SAR 2,400, 4 shops. Total discounts: 8 × 4,000 + 5 × 6,400 + 4 × 2,400 = SAR 73,600 discount. But: 17 of 20 shops (85%) renew contracts, only 3 move. Without discount, estimate is only 30-40% renew. Financial benefit for owner: avoiding expected vacancies 8-12 months × 80,000 = SAR 640,000-960,000 potential loss. Discount SAR 73,600 costs 1/10 of potential loss. Smart strategic decision.
