Short Definition

A penthouse is a residential unit on the top floor of a building, usually distinguished by a larger area, higher ceilings, a private terrace or roof, open views and greater privacy; it is typically among the highest-priced units in the building.

Overview

A penthouse is a residential unit on the top floor of a building, usually distinguished by a larger area, higher ceilings, a private terrace or roof, open views and greater privacy; it is typically among the highest-priced units in the building. In the Saudi market the concept is also known by names such as ‘roof’ or ‘top-floor flat with roof’. What matters legally is not the name but the boundaries of ownership: in a separately titled jointly owned building, the roof is usually a common part under the Law of Ownership, Partition and Management of Real Estate Units, so a terrace or roof belongs exclusively to the penthouse only if it is included within the unit's boundaries or allocated to it in the owners' association bylaws. The law requires the seller to provide a disclosure statement on the unit's specifications, annexes, rights and obligations, and gives the buyer a right to rescind within 30 days if material information harmful to them was omitted. An owner's share of common-part costs is calculated in proportion to the area of their unit, so a larger penthouse carries a larger share. In practice, buyers pay a premium for views, privacy and outdoor space, so they should verify that the terrace is registered to or allocated to their unit, check thermal and waterproof insulation because the top floor is more exposed to heat and leaks, and confirm that any existing rooftop annex is licensed. In a lease, the tenant's right to use the terrace or roof and responsibility for its maintenance should be stated expressly.

Legal Basis

Ownership of a penthouse in a jointly owned building is governed by the Law of Ownership, Partition and Management of Real Estate Units issued by Royal Decree No. (M/85) dated 2/7/1441H: Article 1 defines the separately titled unit and common parts, Article 6 requires the seller to provide a disclosure statement on the unit's specifications and annexes and allows the buyer to rescind within 30 days if material information was omitted, and Article 26 allocates common-part costs in proportion to unit area. Article 7 of the Real Estate Marketing and Advertising Regulation prohibits adverts containing data contrary to reality or suggesting something inconsistent with the nature of the property. A sale is subject to the 5% Real Estate Transaction Tax.

Practical Example

A buyer considers a penthouse in Jeddah with 250 m² of interior space and a 120 m² terrace priced at SAR 2,400,000, while similar mid-floor flats sell for about SAR 7,000 per square metre, SAR 1,750,000 for 250 m². The premium is SAR 650,000 (about 37%) for the terrace and view. Requesting the disclosure statement, he finds the terrace is not listed within the unit's boundaries in the title deed, so before signing he requires the owners' association general assembly to allocate the terrace to the unit in its bylaws and to attach this to the contract. He then calculates the 5% Real Estate Transaction Tax: SAR 120,000.

Common Mistakes

  • ✗Paying a premium for a terrace or roof without checking that it lies within the unit's boundaries in the deed or is allocated to it in the bylaws.
  • ✗Building on the roof or covering the terrace without a building permit and owners' association approval in a jointly owned property.
  • ✗Skipping inspection of thermal and waterproof insulation on the top floor, which is most exposed to heat and leaks.
  • ✗Relying on the word ‘penthouse’ in an advert without comparing actual areas and specifications.
  • ✗Overlooking that an owner's share of common-part costs is proportional to unit area and therefore higher for a large penthouse.

International Differences

In the UAE, penthouses are common in luxury towers and terrace areas are usually registered as part of the unit in the title deed. In Turkey the concept is known as the ‘çatı katı’ flat, and roof rights are determined under the Condominium Law. In New York and London, penthouses are among the most expensive homes. The common thread is that a penthouse's value depends on documented terrace and roof rights, not on the label.

FAQs

Is the terrace or roof the private property of the penthouse?▾
Not necessarily. In a jointly owned building the roof is usually a common part, and it belongs exclusively to the penthouse only if it is included within the unit's boundaries in the deed or allocated to it in the owners' association bylaws.
How can I verify a penthouse's boundaries before buying?▾
Ask for the title deed, the partition document and the disclosure statement the law requires from the seller, and check that the terrace and its area are included in or allocated to the unit. If material information harmful to you was omitted, you may seek rescission within 30 days.
Can an annex be built on a penthouse roof?▾
Only with a building permit under municipal requirements and within the structure's load capacity; in a jointly owned building it must also respect the owners' rights in common parts and their association's decisions.
Why are service charges higher for a penthouse?▾
Because each owner's share of the maintenance and management costs of common parts is calculated by the area of their unit relative to the total area, and penthouses are usually larger.
What technical problems are common in penthouses?▾
Heat gain from direct sun exposure, water leaks from the roof and terrace, and pressure on water tanks and air-conditioning equipment on the roof. Insulation and drainage should therefore be inspected before buying.
