Short Definition

A luxury property is a residential or commercial property in the top tier of the market in terms of price, location, design quality, finishes and amenities, such as large villas and upper-floor apartments in prime or waterfront locations; it targets a limited pool of high-net-worth buyers and tenants.

Overview

A luxury property is a residential or commercial property in the top tier of the market in terms of price, location, design quality, finishes and amenities, such as large villas and upper-floor apartments in prime or waterfront locations; it targets a limited pool of high-net-worth buyers and tenants. Saudi regulations contain no definition or price threshold for ‘luxury property’; the label is a market one that varies by city. Several laws nevertheless affect this segment directly. A sale is subject to the 5% Real Estate Transaction Tax, and state support for a citizen's first home covers only the tax on the first SAR 1 million of value. The Premium Residency product for real estate owners requires an existing residential property worth at least SAR 4 million, not financed by a mortgage and valued by an accredited valuer. Since January 2026 the Law of Real Estate Ownership by Non-Saudis, issued by Royal Decree No. (M/14) dated 19/1/1447H, has been in force: it allows ownership within geographic zones set by the Council of Ministers, imposes a fee of up to 5% of the transaction value, which the implementing regulation set at 2% in Riyadh city, Makkah city, Madinah city and Jeddah Governorate and 0% elsewhere, and limits ownership in Makkah and Madinah to Muslim individuals. In practice, the luxury market is characterised by few transactions, long selling periods and greater sensitivity to economic cycles, and a high price does not necessarily mean a higher rental return; luxury property often yields relatively less than mid-market property. The Real Estate Marketing and Advertising Regulation also prohibits adverts that contain data contrary to reality or suggest something inconsistent with the nature of the property, so a ‘luxury’ label must be backed by actual specifications.

Legal Basis

No Saudi law defines ‘luxury property’, but the segment is subject to the Real Estate Transaction Tax Law issued by Royal Decree No. (M/84) dated 19/3/1446H and its regulation in force since 10 April 2025 (5% of the property's value), and to the Law of Real Estate Ownership by Non-Saudis issued by Royal Decree No. (M/14) dated 19/1/1447H (Article 2 on geographic zones and the Makkah and Madinah restrictions, and Article 9 on a fee of up to 5%, which its implementing regulation, published 3 July 2026, set at 2% in Riyadh city, Makkah city, Madinah city and Jeddah Governorate and 0% elsewhere), which does not prejudice the Premium Residency Law. Article 7 of the Real Estate Marketing and Advertising Regulation dated 14/11/1447H prohibits adverts containing data contrary to reality.

Practical Example

A Saudi investor buys an existing luxury villa in Hittin, Riyadh, for SAR 6,000,000, so the 5% Real Estate Transaction Tax of SAR 300,000 is due, and he does not qualify for first-home support because he already owns a home. He lets it for SAR 330,000 a year, a gross yield of 5.5%, whereas a mid-market apartment building of the same value could have yielded about 7%, but he prefers the villa for its lower management burden and tenant quality. Had the buyer been a non-Saudi resident, a villa of this value could qualify him for the Premium Residency real estate owner product, provided it is not mortgage-financed and is valued by an accredited valuer, taking into account the non-Saudi ownership fee, which the implementing regulation set at 2% in Riyadh city under a 5% statutory cap, and confirming with REGA how it applies to his case.

Common Mistakes

  • ✗Assuming a high price means a higher rental return, when luxury property often yields relatively less than mid-market property.
  • ✗Relying on the word ‘luxury’ in an advert without checking actual specifications against documented comparable transactions.
  • ✗Ignoring the 5% Real Estate Transaction Tax and transaction costs when calculating returns, or assuming first-home support covers the full value.
  • ✗Rushing a sale in a thin market, although luxury properties usually take longer to sell.
  • ✗Assuming any foreigner can own luxury property anywhere, although the non-Saudi ownership law sets geographic zones and restricts ownership in Makkah and Madinah.

International Differences

Internationally the segment goes by labels such as Prime and Ultra-Prime, with price thresholds that vary by city. In the UAE, buying property above a set value is linked to long-term residence programmes, and in Turkey buying property above a set value is one route to citizenship. What is new in Saudi Arabia since January 2026 is the opening of ownership to non-Saudis within geographic zones and fees, while Premium Residency remains a separate route tied to property value.

FAQs

Is there a legal definition of luxury property in Saudi Arabia?▾
No. No Saudi law sets a price threshold or specifications for luxury property; it is a market classification. Advertising it is, however, subject to the ban on data contrary to reality in the Real Estate Marketing and Advertising Regulation.
How much Real Estate Transaction Tax applies to buying a luxury property?▾
5% of the property's value. State support for a citizen's first home covers only the tax on the first SAR 1 million of value, i.e. a maximum of SAR 50,000.
What are the conditions of Premium Residency for real estate owners?▾
An existing residential property worth at least SAR 4 million, not financed by a mortgage and valued by a valuer accredited by the Saudi Authority for Accredited Valuers. Land does not qualify for this product.
Can a non-Saudi buy luxury property in Saudi Arabia?▾
Yes, under the Law of Real Estate Ownership by Non-Saudis in force since January 2026, within geographic zones set by the Council of Ministers and subject to a fee capped by law at 5% of the transaction value, which the implementing regulation set at 2% in Riyadh city, Makkah city, Madinah city and Jeddah Governorate and 0% elsewhere. A legal resident may also own one residential property outside those zones, except in Makkah and Madinah.
Is luxury property a higher-yielding investment?▾
Not necessarily. Its rental yield is often relatively lower than mid-market property and transactions are fewer and slower. Lower management costs, tenant quality and value growth in scarce locations can partly compensate.
