Short Definition
The occupancy rate is the share of leased units (or leased area) in the total lettable units or area of a property or portfolio, calculated as leased units divided by total units times 100; it is the complement of the vacancy rate.
Overview
Legal Basis
Occupancy is a management and financial metric not set by any legal rule, but it operates within a legal framework: lease documentation on the REGA-supervised Ejar platform, where a documented unified residential lease is an executive instrument enforceable directly at the Execution Court; VAT treatment (residential rent exempt, commercial rent at 15%); the five-year Riyadh rent-increase freeze in force since 25 September 2025; and vacant property fees under the White Land and Vacant Properties Fees Law as amended by Royal Decree M/244 dated 7/11/1446H.
Practical Example
A residential compound in Riyadh has 120 flats at SAR 48,000 a year each, so potential rent at full occupancy is SAR 5,760,000. At quarter-end 111 flats are let, a physical occupancy of 92.5%. But 4 tenants have been in arrears for two months, so only 107 units are actually producing income — an approximate economic occupancy of about 89%. The manager works on two tracks: marketing the nine vacant flats at their last Ejar contract rent as the Riyadh rules require, and pursuing arrears directly at the Execution Court, because unified residential leases documented on Ejar are executive instruments.
Common Mistakes
- ✗Relying on physical occupancy and ignoring economic occupancy, so the property looks full while collections are weak.
- ✗Comparing a commercial or office property's occupancy by unit count instead of leased area.
- ✗Chasing 100% occupancy at any cost through deep discounts or unqualified tenants, which raises defaults later.
- ✗Measuring occupancy on a single date instead of averaging over the period, which hides seasonal vacancy.
- ✗Overlooking occupancy's effect on net operating income when valuing or marketing a property for sale.
International Differences
The concept of occupancy is universal, but disclosure differs: listed real estate funds in the US, Europe and the UAE usually report occupancy by area and by rent, while hotels use a different concept based on occupied room-nights. Investors in most markets target high occupancy in stable residential assets and accept lower levels for offices in downturns. In Saudi Arabia the Riyadh freeze gives occupancy more weight than price increases as a source of income growth.
