Overview
Legal Basis
White Land and Vacant Property Fees Law issued by Royal Decree M/4 dated 12/2/1437H and amended by Royal Decree M/244 dated 7/11/1446H: an annual fee of up to 10% of white-land value applies, provided the land or aggregate land subject to application is at least 5,000 m² (Article 3), with a fine for violators of up to the amount of the fee due (Article 6). Every transfer of land ownership is subject to the 5% Real Estate Transaction Tax under its law issued by Royal Decree M/84 dated 19/3/1446H. Ownership by non-Saudis is governed by the law issued by Royal Decree M/14 dated 19/1/1447H. The CMA’s Real Estate Investment Funds Regulations prohibit REITs from investing in white land (Article 47).
Practical Example
An individual investor buys a 900 m² residential plot in east Riyadh at SAR 1,200 per m² (SAR 1,080,000) and, by agreement with the seller, bears the 5% Real Estate Transaction Tax (SAR 54,000) and a 2.5% brokerage fee (SAR 27,000), for a total cost of SAR 1,161,000 before VAT on the commission. Four years later he sells at SAR 1,450 per m² (SAR 1,305,000) and pays 2.5% brokerage (SAR 32,625), netting SAR 1,272,375. His profit is SAR 111,375 — about 9.6% over four years, or roughly 2.3% a year, which may be lower than less risky alternatives. Had his plot been 6,000 m² within a white-land fee area, an annual fee of up to 10% of its value could have applied.
Common Mistakes
- ✗Calculating profit from the purchase–sale price gap alone, ignoring Real Estate Transaction Tax, brokerage, holding costs and opportunity cost.
- ✗Ignoring white land fees when owning a large plot, or several plots totalling 5,000 m² or more, within an application area.
- ✗Buying land without checking the approved plan, its land use, building regulations and any suspension or restriction on disposal.
- ✗Assuming land prices always rise — decisions that increase supply can lower prices in specific areas.
- ✗Using money that may soon be needed to buy land, although selling land quickly may require a large discount.
International Differences
Many countries levy a general annual property tax on all real estate, such as US property taxes or Turkey’s Emlak Vergisi, whereas Saudi Arabia has no general annual property tax and instead targets idle white land and vacant properties with dedicated fees. In Turkey, gains on property sold within five years of purchase are subject to income tax, while in the UAE land investment is mostly channelled through developers in freehold areas.
