An interim measure is a temporary court order issued to protect a threatened right or preserve an existing situation until the underlying dispute is decided, without deciding the merits.
Overview
An interim measure is a temporary court order issued to protect a threatened right or preserve an existing situation until the underlying dispute is decided, without deciding the merits. In the Saudi system it takes the form of "urgent judiciary" (qada' musta'jal), regulated by the Law of Civil Procedure, and "precautionary attachment" (hajz tahaffuzi), regulated by the Execution Law.
Article 205 of the Law of Civil Procedure provides that the court competent for the merits rules provisionally on urgent matters that risk being lost with time, whether the request is filed on its own or alongside the main case. Under Article 206 urgent claims include inspection to record a condition, travel bans, protecting or restoring possession, stopping new works, receivership, daily wages, and anything else the law treats as urgent; the appearance period is 24 hours. For precautionary attachment, the Execution Law allows a landlord to request attachment of movables or produce inside the leased premises as security for rent due, provided the right is apparent and due, the applicant provides a solvent guarantor or security, and he files the substantive claim within ten days, failing which the attachment lapses. The royal decree issuing the new Execution Law (1447H) keeps the previous law's precautionary-attachment provisions in force until they are moved into the Law of Civil Procedure.
The practical value is speed. Urgent judgments carry provisional enforcement, a challenge does not suspend them, and the appeal period is only ten days. In real estate they are used to record a unit's condition before repairs, halt neighbouring construction that harms a property, place the income of a disputed building under receivership, or attach a tenant's movables that may be spirited away. They do not settle ownership or entitlement, and the applicant bears compensation if he turns out not to be in the right.
⚖️ Legal Basis
Urgent judiciary is based on the Law of Civil Procedure issued by Royal Decree No. (M/1) dated 22/1/1435H: Articles 205–211 on the types of urgent claims, the 24-hour appearance period, travel bans, possession, stopping works and receivership; Article 83(d) on requesting a precautionary or interim measure as an incidental request; Article 169 on provisional enforcement; Article 178 on challenges not suspending enforcement; and Article 187 on the 10-day appeal period. Precautionary attachment is based on Chapter Two of the Execution Law issued by Royal Decree No. (M/53) dated 13/8/1433H (Articles 23–33), which Royal Decree No. (M/237) dated 3/11/1447H keeps in force until moved into the Law of Civil Procedure.
💡 Practical Example
A tenant of a household-goods shop in Riyadh fell SAR 45,000 behind on rent, and the landlord noticed stock being moved out at night. The landlord filed an urgent request for precautionary attachment of the goods and fittings inside the shop as security for the rent due, attaching the lease, the schedule of overdue instalments and photos of the removals, and provided the guarantee the court required. The attachment order was issued; the landlord served it on the tenant and, within ten days, filed the claim to establish the debt and validate the attachment; had he been late, the attachment would have lapsed. Meanwhile the owner of the neighbouring flat requested an urgent inspection to record water leaking from the shop before it was repaired; the court recorded the condition without deciding who was liable, leaving that to the substantive case.
⚠️ Common Mistakes
- ✗Using an urgent request to settle the underlying right — the urgent judge rules provisionally and the ruling does not affect the merits.
- ✗Failing to file the substantive claim within ten days of a precautionary attachment — the attachment lapses if not served and followed by a claim within that period.
- ✗Underestimating the guarantee and compensation requirement — whoever obtains an attachment or travel ban must compensate the other side if he proves not to be in the right.
- ✗Assuming the appeal period for urgent matters is thirty days — it is only ten days.
- ✗Combining a possession claim with a claim to the underlying right — the possession claim is forfeited under Article 209.
🌍 International Differences
Comparable systems offer similar tools under different names. Egypt and the UAE have urgent judiciary and orders on petition for temporary protection of rights. Turkish law distinguishes "ihtiyati tedbir" (a preservation measure) from "ihtiyati haciz" (precautionary attachment securing money debts). England uses interim injunctions and freezing orders. The shared feature is fast, temporary protection, usually conditional on security or an undertaking to compensate the other side if the request proves unjustified.
FAQs
What is the difference between an interim measure and a final judgment?▾
An interim measure temporarily protects a right or preserves a situation until the dispute is decided; it does not touch the underlying right and is not evidence of it. A final judgment decides the dispute itself between the parties.
Can a landlord attach a tenant's belongings inside the leased premises?▾
Yes. The Execution Law lets a landlord request precautionary attachment of movables or produce inside the leased premises as security for rent due, by court order and after providing a guarantor or security, and he must file the substantive claim within ten days.
How fast are urgent cases heard in Saudi courts?▾
The appearance period in urgent cases is 24 hours, which the court may shorten in cases of extreme necessity, and judgments in them carry provisional enforcement.
How long is the challenge period for an urgent judgment?▾
The appeal period for judgments in urgent matters is ten days and the cassation period is fifteen days; a challenge does not suspend enforcement of an urgent judgment.
Did the new Execution Law change the rules on precautionary attachment?▾
The royal decree issuing the new Execution Law (1447H) keeps the previous law's precautionary-attachment provisions in force until they have been moved into the Law of Civil Procedure.
