Short Definition
Hot leads are prospective customers who have shown a clear, near-term intention to buy or rent, for example by requesting a viewing, asking about reservation steps or stating a budget and an imminent move date.
Overview
Legal Basis
Handling hot leads rests on: (1) the Real Estate Brokerage Law, Royal Decree No. M/130 dated 30/11/1443H: the brokerage contract must be written, deposited with REGA and for a fixed term, defaulting to 90 days if none is set (Art. 7); the commission is 2.5% unless otherwise agreed in writing and is borne by the party contracting with the broker (Art. 14); and the broker must not disclose transaction secrets (Art. 10); (2) the Personal Data Protection Law, Royal Decree No. M/19 dated 9/2/1443H, amended by Royal Decree No. M/148 dated 5/9/1444H, which conditions processing for marketing on direct collection from the data subject and their consent, excluding sensitive data (Art. 26), while its Implementing Regulation (Art. 27) requires credit data to be protected and not used beyond the purpose for which it was collected; and (3) REGA's Regulatory Bylaw on Real Estate Marketing and Advertising (2026), which prohibits publishing fake data to collect the information of clients or the public (Art. 7).
Practical Example
An office in Riyadh receives 300 enquiries a month from licensed ads. It applies written qualification criteria: a defined budget, the enquirer is the decision-maker, and a move date within 60 days. Forty-five meet the criteria, are classified as 'hot' and are called within an hour; those who wish sign a deposited brokerage contract before viewings are arranged. Twelve end in leases averaging SAR 60,000 a year, giving a commission of SAR 1,500 per lease (2.5% of the first year's rent) and SAR 18,000 in total. For those who mention they are awaiting financing approval, the fact is noted in their file only to serve their request and is not used in advertising campaigns.
Common Mistakes
- ✗Delaying the response to a hot lead by hours or days, so they deal with a faster office.
- ✗Arranging viewings with a customer who will pay commission without a written, deposited brokerage contract, then being unable to claim the commission.
- ✗Labelling every enquirer as hot without qualification criteria, wasting the team's time on non-serious prospects.
- ✗Publishing fake offers or unreal prices to attract hot leads, which the Real Estate Marketing and Advertising Bylaw prohibits.
- ✗Using a customer's financing information for ad targeting, although the Implementing Regulation bars using credit data beyond the purpose for which it was collected.
International Differences
Classifying leads as hot, warm and cold is a global sales practice, using qualification frameworks such as BANT (budget, authority, need, timing). The Saudi difference is that converting a hot lead into a deal runs through a written brokerage contract deposited with REGA, and credit (financing) data is protected by special rules that bar its use beyond its original purpose. In Europe the GDPR imposes similar limits on data use, and the UAE, Egypt and Turkey each have their own data protection laws.
