Overview
A damages claim is a lawsuit in which the injured party asks the court to order whoever caused the harm to make it good, whether the harm arose from breach of a contract — such as a lease — or from a wrongful act outside any contract. In property disputes, typical examples are a landlord claiming the cost of damage beyond normal wear, a tenant claiming compensation for loss of use because the landlord failed to carry out necessary repairs, and a claim for fair rent when a tenant stays on without right.
The Civil Transactions Law, in force since December 2023, sets clear rules. Every fault that causes harm to another obliges the person at fault to compensate (Article 120). Compensation must fully redress the harm, covering the loss suffered and the gain missed where these are a natural result of the act that the injured party could not avoid with reasonable effort (Articles 136 and 137), and it includes moral harm to natural persons (Article 138). In contractual liability, compensation is due only after the debtor has been given formal notice unless agreed or provided otherwise (Article 175), and a debtor who committed no fraud or gross fault is liable only for harm that was ordinarily foreseeable when contracting (Article 180). A tenant must compensate the landlord for damage to the premises caused by his transgression or negligence and return them in the condition received, except for ordinary use (Articles 430 and 435).
A damages claim succeeds only if the claimant proves three elements: the fault or breach, the harm and its amount, and the causal link between them — which is why courts rely heavily on expert evidence and site inspection under the Law of Evidence. Such claims go to the General Court because they are substantive disputes unsuited to direct execution. Time limits matter: a tort claim is not heard after three years from the date the injured party learned of the harm and the person responsible, and in any case after ten years from the harm (Article 143).
⚖️ Legal Basis
Civil Transactions Law, Royal Decree No. M/191 dated 29/11/1444H: Article 120 (liability for wrongful acts), Articles 136–139 (extent and forms of compensation and moral harm), Article 143 (limitation periods), Articles 175–180 (formal notice, agreed compensation and assessment of contractual damages), and Articles 430 and 435 (tenant obligations). The Law of Evidence (M/43 dated 26/5/1443H) governs inspection and expert evidence. The Law of Civil Procedure (M/1 dated 22/1/1435H) assigns claims for harm caused by delay in performing the adjudicated rights to the court that issued the judgment (Article 73).
💡 Practical Example
A company leased a commercial showroom in Jeddah at SAR 7,500 a month and, at the end of the lease, handed it back with the glass frontage removed and the flooring damaged. The owner filed a damages claim before the General Court for SAR 35,000 in repair costs and SAR 15,000 for two months’ lost rent because the showroom could not be let during repairs — SAR 50,000 in total. The court appointed a technical expert who inspected the site, put the necessary repair cost at SAR 28,000 and found the work needed only one month. The court awarded SAR 28,000 for repairs and SAR 7,500 for the lost month — SAR 35,500 — and rejected the rest as unproven.
⚠️ Common Mistakes
- ✗Claiming a lump sum without proving the amount — compensation matches the proven harm, so invoices, quotations or an expert report are needed.
- ✗Skipping formal notice in contractual claims — compensation is due only after the debtor is notified, unless agreed otherwise or one of the exceptions in Article 176 applies.
- ✗Charging the tenant for normal wear — the tenant returns the premises as received, except for what ordinary use entails.
- ✗Imposing a daily late-payment penalty on rent — agreed compensation is not permitted where the obligation is a sum of money (Article 178).
- ✗Filing too late — a tort claim is not heard three years after learning of the harm and the person responsible, nor ten years after the harm occurred.
🌍 International Differences
Liability rules converge across Arab civil codes: Egypt’s Civil Code and the UAE Civil Transactions Law both impose a duty to compensate harm from wrongful acts, and Turkey’s Code of Obligations applies the same principle in tort. Common-law systems generally require the injured party to mitigate its loss; the Saudi equivalent is that recoverable harm is harm the injured party could not avoid through reasonable effort (Article 137). A distinctive Saudi feature is the bar on agreed compensation for money obligations, which makes contractual “late fees” on rent unreliable.
FAQs
What must be proven to win compensation in Saudi Arabia?▾
A fault or breach of obligation, actual harm, and a causal link between them. Compensation is set to fully redress the harm, covering losses incurred and gains missed where they are a natural result of the wrongful act.
Can a landlord claim lost rent while damage is being repaired?▾
Yes, if it is proven that the repairs prevented letting the property and that this was a natural result of the damage, since compensation covers lost gain under Article 137 of the Civil Transactions Law; the court sets the period on the evidence.
Is a penalty clause in a lease enforceable?▾
Parties may fix compensation in advance unless the obligation is a sum of money, such as rent. The court may reduce it if excessive or if the obligation was partly performed, or raise it to match the harm in cases of fraud or gross fault.
Does compensation cover moral harm?▾
Yes. Compensation for a wrongful act includes moral harm suffered by a natural person — physical or psychological suffering from an attack on body, liberty, honour, reputation or social standing — as assessed by the court (Article 138).
Where is a damages claim in a rental dispute filed?▾
Through Najiz before the General Court, because it is a substantive dispute requiring proof and is not suited to direct execution unless the amount is fixed in an executive instrument. If there is an arbitration agreement, it can go to the Saudi Real Estate Arbitration Center.
