Short Definition

A court judgment is the decision a competent court issues on the merits of a case before it, settling the dispute between the parties and defining their rights and obligations; it is recorded in a judgment deed (sakk) stating the operative ruling and its reasons.

Overview

A court judgment is the decision a competent court issues on the merits of a case before it, settling the dispute between the parties and defining their rights and obligations; it is recorded in a judgment deed (sakk) stating the operative ruling and its reasons. In Saudi Arabia judgments are first issued by courts of first instance (general, commercial, labour, personal-status and others) and may be reviewed by the courts of appeal and then the Supreme Court under the Law of Civil Procedure (Royal Decree M/1 dated 22/1/1435H). The objection period starts when the losing party receives a copy of the judgment deed, or on the date set for receiving it (Art. 179): thirty days for an appeal or a request for review, and ten days in urgent (summary) matters (Art. 187). If the period passes without objection, or the court of appeal upholds the ruling, the judgment becomes final (acquires finality). As a rule, a judgment cannot be forcibly enforced while it is still open to objection unless it carries expedited enforcement (Article 10 of the Execution Law). Judgments in petty cases defined by the Supreme Judicial Council are not appealable (Art. 185). In property disputes the General Court hears real-estate cases, including eviction and rent payment, unless a law provides otherwise (Article 31 of the Law of Civil Procedure). A judgment is the first type of executive instrument listed in Article 9 of the Execution Law, so the winning party takes it to the Execution Court to collect money or recover the property. Note that a new Execution (Enforcement) Law issued by Royal Decree M/237 dated 3/11/1447H takes effect on 28 October 2026 and replaces the 1433H law, so the procedure in force on the filing date should be checked.

Legal Basis

Law of Civil Procedure issued by Royal Decree M/1 dated 22/1/1435H: Article 31 (General Court jurisdiction over real-estate cases) and Articles 176–204 (methods and deadlines for objecting to judgments). Execution Law issued by Royal Decree M/53 dated 13/8/1433H: Article 9 (executive instruments) and Article 10 (no forced enforcement while objection is possible, except with expedited enforcement). It is replaced from 28 October 2026 by the Execution Law issued by Royal Decree M/237 dated 3/11/1447H.

Practical Example

The owner of a building in Dammam sues a shop tenant — who claims to have paid in cash — before the General Court for SAR 60,000 in rent arrears and for eviction because the lease has ended. The court orders the tenant to pay the amount and vacate, and both parties receive a copy of the judgment deed the same day. The tenant does not object within thirty days, so finality is recorded on the deed. The owner files the judgment with the Execution Court; an execution order is issued and served. Because the tenant does not pay within five days he is deemed a defaulter and his bank account is attached, and on the day after five days have passed from service of the eviction order an execution officer goes to the shop and hands it back to the owner.

Common Mistakes

  • ✗Missing the objection deadline — it runs from receipt of the judgment copy (or the date set for receiving it), not from when the losing party later learns of it.
  • ✗Assuming a first-instance judgment is enforceable immediately — it cannot be forcibly enforced while objection is possible unless it carries expedited enforcement.
  • ✗Confusing the judgment with the execution order — the judgment settles the dispute; collection and eviction require a separate request to the Execution Court.
  • ✗Filing a property case before the wrong type of court — eviction and rent cases belong to the General Court unless a law provides otherwise.
  • ✗Not reviewing the operative part and reasons before the deadline — clerical errors can be corrected on request, and ambiguity can be referred back to the issuing court for interpretation.

International Differences

Egypt has a tiered structure of first-instance courts, courts of appeal and a Court of Cassation; Turkey has, since 2016, two levels of review — appeal (istinaf) to regional courts and then cassation (temyiz) to the Court of Cassation (Yargıtay). The UAE runs federal courts alongside independent local judiciaries in Dubai and Abu Dhabi. In Saudi Arabia, foreign judgments are enforced before the execution judge subject to conditions that include reciprocity and consistency with public order, and the new Execution Law reorganises these rules from 28 October 2026.

FAQs

When does a court judgment become final in Saudi Arabia?▾
A judgment acquires finality when the objection period expires without an objection, or when the court of appeal upholds it. Finality is then noted on the judgment deed and record under Article 187 of the Law of Civil Procedure.
How long is the period to object to a judgment?▾
Thirty days to request an appeal or review, and ten days for judgments in urgent (summary) matters. The period runs from receipt of a copy of the judgment deed or from the date set for receiving it.
Can a judgment be enforced before it becomes final?▾
Generally not. Article 10 of the Execution Law bars forced enforcement while objection is still possible, unless the judgment carries expedited enforcement, as with rulings in urgent matters.
Which court issues rent and eviction judgments?▾
The General Court, which hears real-estate cases including eviction and rent payment under Article 31 of the Law of Civil Procedure. A unified residential lease documented on Ejar, however, can go straight to the Execution Court as an executive instrument without a judgment.
What is the difference between a judgment and an executive instrument?▾
A judgment is one type of executive instrument listed in Article 9 of the Execution Law, which also covers settlement records, commercial papers and notarised contracts and documents. Every enforceable judgment is an executive instrument, but not every executive instrument is a judgment.
