Short Definition

A short-term rental is the letting of a residential unit, usually furnished, for a short period ranging from one night to a few weeks or months, to tourists, visitors, business travellers and people relocating temporarily, at a daily, weekly or monthly rate that is usually higher, pro rata, than annual rent.

Overview

A short-term rental is the letting of a residential unit, usually furnished, for a short period ranging from one night to a few weeks or months, to tourists, visitors, business travellers and people relocating temporarily, at a daily, weekly or monthly rate that is usually higher, pro rata, than annual rent. In Saudi Arabia, regulation depends on how the unit is used. Letting a private property unit to tourists for paid overnight stays makes it a ‘private hospitality unit’ governed by the Tourism Law issued by Royal Decree No. (M/18) dated 26/1/1444H and the Private Hospitality Unit Regulation published in the Umm Al-Qura Gazette on 11 September 2026 and in force from publication. It may not operate without a Ministry of Tourism licence valid for no more than one year; the applicant must be a Saudi national or a non-Saudi owner of the unit and provide an electronic title deed or proof of a right to use it for the whole licence period; the property must be residential, agricultural or mixed residential-commercial; the owners’ association bylaws and decisions in a jointly owned building must not bar or restrict daily letting; and a tourist’s stay may not exceed 29 consecutive days. Since 1 January 2025, booking platforms have been required not to list unlicensed facilities, with penalties of up to a SAR 1 million fine or closure of the facility. Such temporary stays are not residential real estate under the VAT regulations, so they are taxed at 15% when the operator is VAT-registered. Letting a unit for a few months to someone who makes it their home, by contrast, is a residential lease governed by the Civil Transactions Law and documented on Ejar. In practice, short-term rentals earn more in peak seasons and tourist cities but bring volatile occupancy and costs for operation, cleaning, furniture and platform commissions. A tenant who wants to re-let their flat by the night needs the owner's permission, because the Civil Transactions Law prohibits subletting without the landlord's consent.

Legal Basis

Daily letting rests on the Tourism Law issued by Royal Decree No. (M/18) dated 26/1/1444H and the Private Hospitality Unit Regulation issued by decision of the Minister of Tourism and published in the Umm Al-Qura Gazette on 11 September 2026: Article 3 bars operating the unit without a licence, Article 4 requires a residential, agricultural or mixed residential-commercial property, Article 5 requires the applicant to be a Saudi national or a non-Saudi owner of the unit with an electronic title deed or proof of a right of use, and the owners’ association bylaws and decisions not to bar or restrict daily letting, Article 8 limits the licence to one year, and Article 11 caps a tourist’s stay at 29 consecutive days. Paragraph 3 of Article 30 of the VAT Implementing Regulations excludes temporary accommodation from the definition of residential real estate. Article 437 of the Civil Transactions Law bars subletting without the landlord's permission.

Practical Example

A citizen who owns a furnished flat in Al-Shati, Jeddah, obtains a private hospitality unit licence from the Ministry of Tourism and lists it on a booking platform at SAR 450 a night. Over a year, occupancy is 60%, or 219 nights, giving revenue of SAR 98,550. He deducts the platform's 15% commission (SAR 14,783), cleaning at SAR 60 per booking for about 73 bookings (SAR 4,380) and electricity, internet and maintenance of SAR 9,000, leaving net income of about SAR 70,387, compared with SAR 48,000 if he let it annually. He must, however, renew the licence each year and absorb volatile occupancy, and if he is VAT-registered he must add 15% to nightly rates.

Common Mistakes

  • ✗Listing a flat for daily rental on booking platforms without a Ministry of Tourism licence, although penalties can reach a SAR 1 million fine or closure.
  • ✗A tenant re-letting the flat by the night without the owner's permission, although the law prohibits subletting without the landlord's consent.
  • ✗Overlooking the requirement that the owners’ association bylaws and decisions in a jointly owned building do not bar or restrict daily letting.
  • ✗Calculating returns as the nightly rate times 365 without accounting for actual occupancy, commissions, cleaning and furniture.
  • ✗Confusing a monthly lease to someone making the unit their home (a residential lease) with temporary tourist accommodation (taxable hospitality).

International Differences

Many countries now regulate short-term rentals through licences and night limits. In Dubai, holiday home letting requires a permit from the competent tourism authority. In Turkey, the law requires a permit from the Ministry of Culture and Tourism to let homes to tourists. Several European cities impose caps on nights or mandatory registration. The Saudi model stands out for obliging platforms, since 2025, not to list unlicensed facilities.

FAQs

Do I need a licence to let my flat by the day in Saudi Arabia?▾
Yes. Letting a unit to tourists for paid overnight stays requires a ‘private hospitality unit’ licence from the Ministry of Tourism under the Private Hospitality Unit Regulation (Umm Al-Qura, 11 September 2026), valid for no more than one year; the application fee is SAR 1,100. Since 1 January 2025, booking platforms may not list unlicensed facilities.
What is the penalty for daily letting without a licence?▾
The Ministry of Tourism has announced that failing to obtain the licence or permit exposes violators to penalties of up to a SAR 1 million fine, closure of the facility, or both.
Are short-term rentals subject to VAT?▾
Temporary accommodation for visitors is not residential real estate under the VAT regulations, so it is taxed at 15% when the operator is VAT-registered. Letting a unit to someone who makes it their home, even for a few months, remains an exempt residential lease.
Can a tenant let their flat by the day on platforms?▾
Not without the owner's permission, because the Civil Transactions Law prevents a tenant from letting or assigning the premises without the landlord's permission or approval, in addition to the Ministry of Tourism licence requirement.
Is short-term letting more profitable than annual letting?▾
It can yield higher gross income in peak seasons and tourist cities, but net returns depend on actual occupancy, platform commissions, cleaning, furniture and licence renewal. Compare net, not gross, figures.
