Short Definition
A service level agreement (SLA) is a document or contract schedule that sets measurable standards for service quality and speed, such as response time to maintenance requests, time to close and service hours, and specifies what happens if they are not met.
Overview
Legal Basis
An SLA rests on freedom of contract under the Civil Transactions Law (Royal Decree M/191 dated 29/11/1444H) and draws its substance from duties already in that law: the landlord's duty to make necessary repairs (Article 419), a paid agent's duty to exercise ordinary-person care (Article 487), and the contracting (muqawala) provisions that govern the manager's relationship with maintenance contractors. REGA issues a Fal Facility Management Licence to establishments that handle a property's technical affairs on behalf of its owner or usufruct holder.
Practical Example
The owner of an office tower in Riyadh (60 offices) hires a management establishment for SAR 180,000 a year, with an SLA schedule: emergencies answered within 2 hours with a temporary fix within 6 hours, urgent jobs within 24 hours, routine jobs within 3 working days, and a monthly compliance target of at least 95%. If compliance falls below 90% in a month, 5% of that month's fee is deducted (SAR 750 of SAR 15,000). In March the establishment scores 88% because of delays on AC requests, so the deduction applies and it commits to a corrective plan; if the breach repeats for three consecutive months, the owner may terminate.
Common Mistakes
- ✗Wording commitments vaguely, such as 'as soon as possible', instead of specific measurable times.
- ✗Confusing response time (technician arrival or first reply) with fix time (actually solving the problem).
- ✗Setting standards with no measurement method, reporting or consequences for breach, so the SLA exists only on paper.
- ✗Setting unrealistic times that contractors cannot meet, so the SLA loses credibility from the first month.
- ✗Not aligning the owner-manager SLA with the manager's contractor contracts, so the manager commits to what its contractors do not.
International Differences
SLAs originated in information technology and spread to facility management and commercial real estate worldwide, becoming standard in facility management contracts across the Gulf and Europe. In the UAE they are widely used in facility management contracts for towers and communities, and in Turkey for shopping centres and large office buildings. In Saudi Arabia their use is growing with the licensed facility management sector and large-scale projects, while they remain less common in small residential buildings managed directly by their owners.
