Legal Basis
The Real Property Registration Law was issued by Royal Decree M/91 dated 19/9/1443H. It makes the property the primary anchor for recording ownership and related transactions, aiming to build a complete national registry. The Real Estate General Authority enforces registration work as prescribed by law, within its mandate under Council of Ministers Decision 239 dated 25/4/1438H. The system is implemented across areas announced in phases, with the Authority Geospatial Real Estate Portal displaying areas announced for registration. Registration integrates with the electronic title deed issued by the Ministry of Justice through the Najiz portal.
Practical Example
An owner of land in a district announced within the registration scope wants to sell it for SAR 1,800,000. He checks the Geospatial Real Estate Portal to confirm his district is among the announced areas, after which an independent page is opened for his property in the registry recording its details, boundaries and any rights over it. The buyer and his lender can review recorded rights from a single source rather than tracing a chain of old deeds. On transfer, 5% real estate transaction tax of SAR 90,000 is paid. The practical benefit is that boundary disputes and duplicate deeds all but disappear, and these are the leading causes of stalled transactions in older districts.
Common Mistakes
- ✗Assuming registration applies across the whole Kingdom at once, when it is implemented over areas announced in phases that can be checked on the Geospatial Real Estate Portal.
- ✗Confusing registration with the electronic title deed. The former is a system building a property-anchored registry, the latter a digital ownership document issued by the Ministry of Justice; they are complementary, not alternatives.
- ✗Believing registration removes the need to update a paper deed, when title transfer still requires a valid electronic deed.
- ✗Neglecting to verify whether a property falls within registration scope before planning a transaction that relies on registry entries.
International Differences
In the UAE, Dubai registration is based on recording the unit or plot with the Land Department alongside an electronic title deed, a property-anchored model applied emirate-wide for years. In Turkey, the land registry and cadastre system records each parcel in an independent register supported by comprehensive cadastral survey, among the oldest property-anchored systems in the region. In Egypt, personal registration predominates through the real estate publicity department, with limited formal registration relative to market size. Saudi Arabia differs in transitioning gradually from personal to property-anchored registration across announced areas while preserving the standing of existing deeds during the transition.
