Short Definition
A loan application (home finance application) is the formal request a prospective borrower submits to a licensed bank or finance company, containing personal, financial and property data and supporting documents; it is the basis for assessing creditworthiness and issuing a finance decision.
Overview
Legal Basis
The Real Estate Finance Law (Royal Decree No. M/50 dated 13/8/1433H) and its Implementing Regulation: Article 8 (SAMA no-objection to products), Article 9 (mandatory contract contents), Article 10 (plain-language contract summary) and Article 13 (consumer consent to inquiry and data registration, with rejection without it). The Guide to Financial Institutions Services Fees issued by SAMA Circular No. 472038000 dated 2/7/1447H (22 December 2025): home finance administrative fees capped at 1% or SAR 5,000, whichever is lower, and free mortgage release after full settlement. Article 45 of the Implementing Regulations of the Credit Information Law (reasons for an adverse decision within seven business days on request).
Practical Example
Fahd, a government employee earning SAR 20,000, applies for SAR 800,000 to buy a SAR 1,000,000 villa in Buraidah as his first home. He attaches his ID, a salary certificate and six months of bank statements, and signs consent to the credit inquiry and to registering his data with the credit bureau. After pre-approval he submits the villa's title deed; an accredited valuer values it at SAR 1,000,000 and the bank verifies the deed is free of mortgages. Fahd receives the contract summary and then the contract, stating the APR, total amount payable, installment schedule and early-repayment terms. Administrative fees: 1% of SAR 800,000 is SAR 8,000, but the SAR 5,000 cap is lower and applies, plus SAR 750 VAT. He signs, the villa is transferred, and a mortgage is registered in favour of the bank.
Common Mistakes
- ✗Giving inaccurate income or obligation data, which the lender verifies and which can lead to rejection or later cancellation.
- ✗Refusing to sign consent to the credit inquiry, when the rules require the lender to reject the application without it.
- ✗Signing without reading the summary, APR, early-repayment terms and right of withdrawal.
- ✗Accepting administrative fees above 1% of the finance amount or SAR 5,000, whichever is lower.
- ✗Not asking for written reasons when declined because of the credit record, a right that allows errors to be corrected.
International Differences
In the US a uniform residential loan application is used and lenders must provide a loan estimate shortly after application; in the EU lenders must give a standardised pre-contract information sheet. In the UAE, Turkey and Egypt procedures depend on banks, with general disclosure requirements from central banks. Saudi Arabia stands out for a legal requirement of consumer consent to credit inquiries, a plain-language contract summary and a fixed cap on administrative fees.
