Short Definition

Land surveying is the measurement of land to fix its location, boundaries, dimensions, area and coordinates with specialised equipment, issued as a survey report or 'survey decision' relied on for deeds, cadastral registration, building permits, subdivision and merger.

Overview

Land surveying is the measurement of land to fix its location, boundaries, dimensions, area and coordinates with specialised equipment, issued as a survey report or 'survey decision' relied on for deeds, cadastral registration, building permits, subdivision and merger. In Saudi Arabia the survey report (commonly called the qarar masahi) is issued through the Balady platform of the Ministry of Municipalities and Housing after contracting an engineering office accredited for surveying. It requires an updated Ministry of Justice deed or another ownership document, is valid for three years, and is used for building permits, deed updates and land subdivision. Under the Law of Real Estate Registration (Royal Decree M/91 dated 19/9/1443H), REGA carries out the survey work needed for registration according to national geospatial standards and may use aerial and satellite imagery and other modern technologies (Art. 3), or rely on approved existing survey data (Art. 8). The register is built on a cadastral map based on a national coordinate system showing the property's location, boundaries, landmarks and area (Art. 1). The law requires anyone conducting survey work related to registration to be licensed by the relevant agency and listed in a register kept by REGA (Art. 32), and a subdivision or merger is recorded only after approval by the agency in charge (Art. 33). In practice a survey is the single most important check before buying or building on land, because it reveals area differences, encroachments and whether the deed matches the ground. It is relied on in boundary disputes and in applications for title-by-possession deeds (istihkam), which require an approved survey report.

Legal Basis

Survey work for registration is governed by Articles 1, 3, 8, 32 and 33 of the Law of Real Estate Registration (Royal Decree M/91 dated 19/9/1443H), covering the definition of the cadastral map, REGA's responsibility for survey work under national geospatial standards, the licensing of surveyors and the recording of subdivisions and mergers. For municipal purposes, the survey report is issued through the Balady platform by an accredited engineering office and is valid for three years. The Law of Procedure before Sharia Courts requires an approved survey report for an application for a title-by-possession deed (istihkam).

Practical Example

Before buying a plot in north Riyadh at SAR 2,500 per square metre, the buyer insists on a survey. The deed states the plot is 20 × 30 metres, i.e. 600 m², but the accredited engineering office issues a report through Balady showing the actual area is 585 m² because of an earlier street widening. The parties negotiate and the price is reduced by 15 m² × 2,500 = SAR 37,500, to SAR 1,462,500 instead of SAR 1,500,000, and the deed is updated with the correct area before conveyance. Without the survey, he would have had to claim the difference within one year of delivery.

Common Mistakes

  • ✗Buying land based on the deed's dimensions without a survey matching them to the ground.
  • ✗Hiring an entity not accredited for surveying, so its report is not accepted by Balady or for registration.
  • ✗Using an expired survey report (older than three years) for a permit or deed update.
  • ✗Building the boundary wall or foundations before fixing the boundaries by coordinates on the ground.
  • ✗Assuming a subdivision or merger can be done by owners' agreement alone; it is recorded only after approval by the competent agency.

International Differences

In Turkey, the General Directorate of Land Registry and Cadastre (TKGM) carries out official cadastral surveying, and licensed surveyors handle subdivisions. In the UAE, land departments rely on registered surveyors to issue plans. In common-law countries, licensed surveyors produce boundary surveys often attached to purchase contracts. Saudi Arabia's new system is moving towards a unified cadastre based on national coordinates.

FAQs

What is a survey decision (qarar masahi)?▾
It is an official report issued through the Balady platform by an engineering office accredited for surveying, showing the property's boundaries, dimensions, area and coordinates. It is used for building permits, deed updates and land subdivision.
How long is a survey report valid?▾
A survey decision issued through Balady is valid for three years from its issue date; once it expires, a new survey decision must be requested.
Who carries out survey work for cadastral registration?▾
REGA carries out the survey work required for registration according to national geospatial standards and may use aerial and satellite imagery. Anyone performing such work must be licensed and listed in a register kept by REGA.
Is there a fee for first registration and its survey work?▾
The Law of Real Estate Registration provides that first registration is free of charge, with REGA conducting the necessary survey work. Later services are charged according to a fee schedule approved by the Council of Ministers.
Why is a survey recommended before buying land?▾
It reveals any difference between the deed area and the actual area, any encroachments onto or from the land, and whether the location matches the deed. This protects the buyer from later disputes and from missing the one-year deadline to claim an area difference.
