Short Definition
A land plot is a portion of land with a defined area, dimensions and boundaries, identified by a plot number in an approved subdivision plan or described in a title deed, whose permitted building and use are set by the building system and land-use rules that apply to its location.
Overview
A land plot is a portion of land with a defined area, dimensions and boundaries, identified by a plot number in an approved subdivision plan or described in a title deed, whose permitted building and use are set by the building system and land-use rules that apply to its location. A plot may be vacant or built on; the term is descriptive and carries no legal status by itself.
In Saudi Arabia, ownership of a plot is proven by a title deed, and the market is gradually moving to registration deeds under the Real Estate Registration Law, Royal Decree M/91 dated 19/9/1443H, which the Real Estate General Authority (REGA) applies in announced real-estate zones while previous documentation systems continue outside them. Each plot in an approved plan has a number, area, dimensions and use (residential, commercial, mixed residential-commercial, industrial, etc.) and a building system that sets the coverage ratio, number of floors and setbacks; a building permit is issued through Balady only in line with it. A sale of the plot is subject to the 5% Real Estate Transaction Tax under Royal Decree M/84 dated 19/3/1446H. If it is undeveloped and measures 5,000 m² or more, alone or together with the owner's other land in the same city, within an announced scope, it may be subject to White Land fees of up to 10% of its value a year depending on development priority, and any fee due must be paid before ownership is transferred if the land is sold before development.
In practice, a plot is valued by its location, frontages, number and width of adjoining streets, permitted use and the completeness of services in the plan, and valuations are carried out by valuers licensed by the Saudi Authority for Accredited Valuers (Taqeem). Before buying, check that the deed is valid and free of mortgages or restrictions, that the boundaries match on the ground, and review the plan and building system. The broker must hold a Fal licence and every property advertisement needs a REGA ad licence, while developed plots sold off-plan before development is complete fall under the Off-Plan Sale and Lease of Real Estate Projects Law (Wafi).
⚖️ Legal Basis
Land plots are governed by the Real Estate Registration Law, Royal Decree M/91 dated 19/9/1443H (REGA); the White Land Fees and Vacant Properties Law as amended and renamed by Royal Decree M/244 dated 7/11/1446H and its implementing regulation; the Real Estate Transaction Tax Law, Royal Decree M/84 dated 19/3/1446H (5%); and the Real Estate Brokerage Law, Royal Decree M/130 dated 30/11/1443H, for marketing, alongside the approved subdivision plans and building systems administered by MOMAH.
💡 Practical Example
A citizen buys a 625 m² residential plot (25 × 25 m) in an approved subdivision in Jeddah at SAR 2,000 per m², i.e. SAR 1,250,000. Before conveyance he checks the deed, the plot number, the plan and the building system that sets floors, coverage and setbacks, budgets the 5% Real Estate Transaction Tax = SAR 62,500, and checks whether his purchase qualifies for the state-borne first-home tax under Sakani's conditions. Because the plot is under 5,000 m², it is not subject to White Land fees on its own, but if he owned other undeveloped land in Jeddah bringing his total to 5,000 m² or more within an announced scope, the fees could apply. After the transfer he obtains a building permit through Balady in line with the building system.
⚠️ Common Mistakes
- ✗Buying on the strength of an advert or sketch without matching the deed, the approved plan and the boundaries on the ground.
- ✗Assuming any plot can take any building; use, coverage ratio, number of floors and setbacks are set by the building system for the location.
- ✗Leaving out the 5% Real Estate Transaction Tax when budgeting, or confusing it with VAT, which does not apply to property sales.
- ✗Ignoring that White Land fees aggregate an owner's land within the same city, or selling land with a fee due before paying it, although it must be paid before ownership is transferred.
- ✗Dealing with a marketer without a Fal licence or relying on an advertisement that has no REGA ad licence.
🌍 International Differences
In Turkey, a plot's buildability is read from its title deed (tapu) and the municipality's zoning status (imar durumu), which sets the floor-area ratio and height; in the UAE, ownership by non-citizens is generally limited to designated freehold areas; and in Egypt many plots are still unregistered in the real-estate registry, so buyers often rely on contracts and court rulings. Saudi Arabia stands out for a registration-deed system rolled out zone by zone and for annual fees on large undeveloped land inside cities.
FAQs
What is the difference between a land plot and white land?▾
A land plot is a general term for any portion of land with defined boundaries and area, built or not, whereas white land is a legal term under the White Land Fees and Vacant Properties Law for undeveloped, developable land within an announced scope measuring 5,000 m² or more, as a single plot or as the owner's combined land in a city.
How can I check whether a plot can be built on?▾
Review the deed and the approved plan for the plot number, area and permitted use, then the building system that sets the coverage ratio, number of floors and setbacks, because a building permit through Balady is issued only in line with them.
What tax applies when buying a land plot in Saudi Arabia?▾
Transferring ownership of land is subject to the 5% Real Estate Transaction Tax under Royal Decree M/84 dated 19/3/1446H, and VAT has not applied to property sales since 4 October 2020.
What is a real-estate registration deed?▾
It is the deed issued under the Real Estate Registration Law, Royal Decree M/91 dated 19/9/1443H, when property is registered in the real-estate zones announced by the Real Estate General Authority. Outside those zones, the previous documentation systems continue to apply.
Are White Land fees charged on a small plot?▾
The threshold is 5,000 m² or more for a single plot or for the owner's combined land in the same city within an announced scope, so a small plot is not caught on its own but may count towards the total. Fees reach up to 10% of the land's value a year depending on development priority.
