Legal Basis
The primary reference is the Real Estate Brokerage Law issued by Royal Decree M/130 dated 30/11/1443H, together with the related Council of Ministers decision requiring practitioners active at the time of entry into force to regularize within 180 days. The law prohibits practising brokerage or providing real estate services without a license from the Real Estate General Authority, and assigns the executive regulation to set licensing terms, conditions, procedures, duration and renewal. Violations include unlicensed practice, submitting false information to obtain a license, and providing misleading information or concealing material facts about a property. Penalties are a warning, suspension for up to one year, revocation, and a fine of up to SAR 200,000, which may be doubled for repeat violations within three years.
Practical Example
An individual broker in Jeddah renews a Fal License for SAR 300 a year, about SAR 25 a month. During the year he closes a villa sale worth SAR 2,000,000 at a 2.5% commission, or SAR 50,000, plus 15% VAT of SAR 7,500, bringing the invoice to SAR 57,500. The annual license therefore costs just 0.6% of a single deal commission. Operating unlicensed, by contrast, can trigger a fine of up to SAR 200,000, some 666 times the license fee, doubled for a repeat violation within three years.
Common Mistakes
- ✗Assuming a commercial registration alone permits brokerage work, when the law requires a Fal License in addition to a valid registration covering the real estate activity.
- ✗Using a brokerage and marketing license to manage third-party properties, when property management is a separate license granted only to companies.
- ✗Omitting the license number from advertisements and brokerage contracts, an explicit legal obligation rather than a formality.
- ✗Delaying annual renewal until expiry, which suspends the license and turns any subsequent activity into a violation.
- ✗Assuming brokers need not disclose conflicts of interest, when the law requires disclosure in writing.
International Differences
In the UAE, brokers must obtain a broker card from RERA under the Dubai Land Department after a training course and examination, with annual renewal and mandatory affiliation with a licensed firm. In Turkey, the real estate trade regulation requires an authorisation certificate from the Ministry of Trade, conditional on a vocational certificate or recognised experience. Egypt applies looser oversight, generally requiring only a commercial registration and membership in the real estate division, without a unified national professional examination. The distinguishing feature of the Saudi model is that licensing is tied to a single central database, letting consumers verify a broker before signing.
