Short Definition
An educational property is a property designed or fitted out to provide education or training, such as nurseries, kindergartens, schools, educational complexes, universities and training institutes; it may operate only under a licence from the competent education authority, in addition to municipal requirements.
Overview
Legal Basis
Private education is licensed by the Ministry of Education, and private training establishments by the Technical and Vocational Training Corporation. The municipal requirements for private educational buildings issued by the Ministry of Municipalities and Housing in December 2025 set the permitted land types, the minimum land area per student and rules on streets, setbacks and boarding accommodation. The lease is governed by the Civil Transactions Law issued by Royal Decree No. (M/191) dated 29/11/1444H, and Article 30 of the VAT Implementing Regulations treats student accommodation as exempt residential real estate, while leases of non-residential educational buildings are standard-rated at 15%.
Practical Example
An investor leases a 6,000 m² commercial plot in a developing district of Jeddah to build a private educational complex. Assuming the minimum for his region is 5 m² per student in educational complexes, the plot can accommodate no more than 1,200 students (6,000 ÷ 5). The annual rent is SAR 900,000 for 15 years, plus 15% VAT because the landlord is registered, i.e. SAR 135,000 a year. The investor stipulates that rent becomes payable only after the building permit is issued, with an 18-month construction grace period, and that he may terminate if the Ministry of Education licence cannot be obtained.
Common Mistakes
- ✗Leasing a residential villa to convert into a school without checking land use and the municipal requirements for educational buildings.
- ✗Calculating capacity from the number of classrooms alone and ignoring the minimum land area per student.
- ✗Signing a short lease that does not match the time needed to recover construction, fit-out and licensing costs.
- ✗Overlooking the width of surrounding streets, parking and drop-off points, which affect licensing and neighbourhood acceptance.
- ✗Confusing Ministry of Education licensing of schools with TVTC licensing of training establishments.
International Differences
In most countries the educational activity is licensed by an education authority and the building by the municipality under safety requirements. In the UAE the licensing body depends on the emirate, such as the Knowledge and Human Development Authority in Dubai and the Department of Education and Knowledge in Abu Dhabi. In Turkey, the Ministry of National Education licenses private schools. Globally, educational property is a specialised asset with long leases and is sometimes financed through sale-and-leaseback deals with school operators.
