Short Definition
Competitive analysis is the systematic study of competing offices, developers and platforms in a given market — their offers, prices, commissions, channels, service quality, strengths and weaknesses — to find ways to stand out and base pricing and marketing decisions on data rather than impressions.
Overview
Legal Basis
The legal limits of competitive analysis: Article 5 of the Competition Law issued by Royal Decree (M/75) dated 29/6/1440H prohibits practices and agreements between businesses — written or oral, explicit or implicit — aimed at fixing or suggesting prices of goods and service fees, or dividing markets by geographic area or client type. Article 14 of the Real Estate Brokerage Law (M/130) sets commission at 2.5% of the deal value or of the first year's rent "unless the parties to the brokerage contract agree otherwise in writing". The Copyright Law (M/41 dated 2/7/1424H) protects photographs and written works, and the Personal Data Protection Law restricts using contact data for marketing (Articles 25 and 26).
Practical Example
A new office in a north Riyadh district tracks 60 active rental listings for three-bedroom flats on licensed platforms over one month. It finds that the average asking rent is SAR 62,000 a year, that listings staying online more than 60 days usually have poor photos and no disclosure of service charges, and that only two offices answer enquiries within an hour. It decides to differentiate through professional photos, full disclosure and fast replies, and sets its commission by written agreement with each owner based on its own cost assessment. When a neighbouring office proposes "agreeing not to go below 2.5%", it refuses, because the Competition Law prohibits competitors from agreeing to fix prices or service fees.
Common Mistakes
- ✗Relying on impressions or "what the market says" instead of systematic tracking of actual listings and deals.
- ✗Comparing asking prices only and ignoring executed transaction prices and time on market.
- ✗Turning the analysis into coordination with competitors on commissions or dividing districts — prohibited by the Competition Law even if the agreement is oral.
- ✗Copying competitors' listing photos or descriptions — copyright infringement and a breach of ad-accuracy principles.
- ✗Harvesting owners' numbers from competitors' listings and contacting them for marketing without consent — a breach of the Personal Data Protection Law.
International Differences
Competitive analysis tools are the same worldwide, but data sources differ: markets such as the UK and the US have had public transaction-price records for years, while in Saudi Arabia official data has expanded through Ministry of Justice platforms and the linking of ads to REGA licences. The shared global constraint is competition law: agreements between agents on uniform commissions have been the subject of antitrust cases in several countries, and Saudi Arabia expressly prohibits them in its Competition Law.
