Short Definition

Agricultural land is land whose approved use is agricultural, such as farms, orchards, palm groves and fields, inside or outside the urban boundary, where the farming activity requires an agricultural register entry or licence from the Ministry of Environment, Water and Agriculture (MEWA).

Overview

Agricultural land is land whose approved use is agricultural, such as farms, orchards, palm groves and fields, inside or outside the urban boundary, where the farming activity requires an agricultural register entry or licence from the Ministry of Environment, Water and Agriculture (MEWA). The licence attaches to the agricultural activity and facility, not to ownership of the land itself. In Saudi Arabia, the Agriculture Law, Royal Decree M/64 dated 10/8/1442H, regulates agricultural activity: under Article 3, MEWA issues the agricultural register and licences for agricultural activities, agricultural services and agricultural facilities (such as farms, nurseries and apiaries), which may not be practised without them, and under Article 25 penalties include a fine of up to SAR 15 million, suspension or cancellation of the licence and closure of the facility for up to one month. Ownership of the land is proven by its deed and transferred by conveyance, and a sale is subject to the 5% Real Estate Transaction Tax like any other real estate. The Civil Transactions Law (Royal Decree M/191 dated 29/11/1444H) devotes a branch to leasing land for agriculture (Articles 443–450): the lease covers the land's appurtenances but not tools and machinery unless agreed (Art. 446); if the lease ends before harvest for reasons beyond the tenant, the tenant may keep the crop until harvest at fair rent (Art. 448); the landlord makes the repairs needed to exploit the land while the tenant handles maintenance, including wells, channels and drains (Art. 449); and if the whole crop is destroyed by force majeure, the tenant may ask for the rent to be waived (Art. 450). Changing agricultural land to residential or commercial use, or dividing it into smaller plots, requires approvals from the competent municipality and MEWA under rules that set minimum farm sizes, so farmland near cities should not be assumed to be automatically plannable for housing. The Private Hospitality Unit Regulation (Umm Al-Qura, 11 September 2026) allows licences for independent private units in residential, agricultural or mixed residential-commercial property, which has made licensed farm stays and rest houses possible. The value of agricultural land depends on water availability, well condition, soil type and proximity to roads and markets.

Legal Basis

Activity on agricultural land is governed by the Agriculture Law, Royal Decree M/64 dated 10/8/1442H (Council of Ministers Resolution No. 431 dated 3/8/1442H): MEWA issues the agricultural register and licences (Art. 3), and fines reach SAR 15 million (Art. 25). Leasing land for agriculture is regulated by the Civil Transactions Law, Royal Decree M/191 dated 29/11/1444H (Arts. 443–450), and a sale is subject to the 5% Real Estate Transaction Tax under Royal Decree M/84 dated 19/3/1446H.

Practical Example

A citizen buys a 20,000 m² palm farm in Al-Qassim for SAR 1,500,000 and pays the 5% Real Estate Transaction Tax = SAR 75,000 before conveyance. He then leases 15,000 m² of it to a farmer for SAR 30,000 a year under a written contract stating that the tenant maintains the well and irrigation channels, the owner carries out the repairs needed to exploit the land, and the pumps are not included in the lease. The tenant obtains an agricultural register entry from MEWA for his activity, and if the term ends before harvest for reasons beyond his control he may keep the crop until harvest at fair rent. The farm also has a separate furnished guest house; to rent it to visitors by the night, the owner obtains a private hospitality unit licence (application fee SAR 1,100) and markets it only through licensed travel and tourism service providers.

Common Mistakes

  • ✗Assuming agricultural land always lies outside the urban boundary or is necessarily cheap; price follows water, location and permitted use.
  • ✗Buying farmland to convert into a residential subdivision without checking whether a change of use is possible and obtaining municipal and MEWA approvals.
  • ✗Practising an agricultural activity or running a nursery or apiary without an agricultural register entry or licence, although fines can reach SAR 15 million and the facility can be closed for up to one month.
  • ✗Leasing a farm without allocating maintenance of wells, channels and drains, or without addressing machinery and pumps, which are not included in the lease unless agreed.
  • ✗Renting a farm rest house by the night without a private hospitality unit licence, although booking platforms have been barred since 1 January 2025 from listing unlicensed facilities.

International Differences

Egypt has long restricted building on or stripping agricultural land to protect its farmland, allowing it only by permit in specific cases. Turkey restricts dividing agricultural land below minimum sizes and requires official permission for non-agricultural use. In Saudi Arabia several authorities intersect: MEWA for the agricultural activity, the municipality for land use and subdivision, the real-estate documentation bodies for proving and transferring ownership, and the Ministry of Tourism when farm units are used for overnight hospitality.

FAQs

Is agricultural land only found outside cities?▾
No. Agricultural land is defined by its approved use, not its location, and farms can lie inside the urban boundary or on its edges, although most are outside cities.
Do I need a licence to farm my land in Saudi Arabia?▾
Article 3 of the Agriculture Law requires an agricultural register entry or licence from MEWA to practise agricultural activities and services and to operate agricultural facilities such as farms, nurseries and apiaries, and the implementing regulation sets any exemptions.
Can agricultural land be converted into a residential subdivision?▾
Changing the use of agricultural land or dividing it requires approvals from the competent municipality and MEWA under rules that set minimum farm sizes, and it does not happen automatically when a city expands towards the land.
What happens to the crop if a farmland lease ends before harvest?▾
Under Article 448 of the Civil Transactions Law, if the lease ends before harvest for a reason beyond the tenant's control, the tenant may keep the crop in the ground until harvest in return for fair rent.
Can a farm rest house be rented to visitors by the night?▾
Yes, once a private hospitality unit licence is obtained from the Ministry of Tourism. The Private Hospitality Unit Regulation allows licences for independent private units in residential, agricultural or mixed residential-commercial property for an applicant who is a Saudi national or a non-Saudi owner of the unit and who submits an electronic title deed or proof of a right to use it for the whole licence term, with bookings and payments only through travel and tourism service providers.
