Short Definition

Damages assessment is the technical process of establishing whether a leased property or unit has been damaged, the extent of the damage and its monetary value — distinguishing damage the tenant is liable for from normal wear and tear he is not — so the amount can be deducted from the security deposit or claimed by agreement or in court.

Overview

Damages assessment is the technical process of establishing whether a leased property or unit has been damaged, the extent of the damage and its monetary value — distinguishing damage the tenant is liable for from normal wear and tear he is not — so the amount can be deducted from the security deposit or claimed by agreement or in court. A sound assessment starts with documenting the unit’s condition at move-in and ends with comparing it with its condition at move-out, supported by photos, invoices and quotations. In Saudi Arabia the assessment rests on two rules of the Civil Transactions Law: the tenant must look after the premises as an ordinary person would and compensate the landlord for damage caused by his transgression or negligence (Article 430), and he must return the premises in the condition received except for what ordinary use entails (Article 435). Paint fading after years of occupancy is usually normal wear, whereas a broken door or a burned kitchen worktop is damage the tenant answers for once his transgression or negligence is shown. Compensation restores the injured party to his previous position (Article 136), so it is not normally priced at the cost of brand-new replacement for an item that was already worn. In a dispute, the Law of Evidence provides the tools. A person who fears that the traces of an event will be lost may file an urgent claim to inspect and record its condition (Article 109); the court may appoint one or more experts on technical matters (Article 110); the parties may agree, even before filing, to accept the expert’s findings, and otherwise the judge is not bound by the expert’s opinion but must give reasons for departing from it (Article 121); and the losing party bears the expert’s fees (Article 122). Valuers accredited by the Saudi Authority for Accredited Valuers (Taqeem) are used for property values, and specialist engineers for structural and technical faults.

Legal Basis

Civil Transactions Law, Royal Decree No. M/191 dated 29/11/1444H: Article 136 (full redress of harm), Article 430 (tenant’s duty of care and liability for damage from transgression or negligence) and Article 435 (return in the condition received, except for ordinary use). Law of Evidence, Royal Decree No. M/43 dated 26/5/1443H: Articles 108–109 (inspection and recording the state of affairs) and Articles 110–124 (expert evidence). The Accredited Valuers Law, Royal Decree No. M/43 dated 9/7/1433H, under which the Saudi Authority for Accredited Valuers regulates the valuation profession.

Practical Example

A three-year lease on a Riyadh apartment ends; the tenant had paid a SAR 5,000 security deposit. The landlord seeks to deduct SAR 7,300: a broken bedroom door (SAR 1,200), a burned kitchen worktop (SAR 2,300) and a full repaint (SAR 3,800). The tenant disputes the repaint, so the parties agree in writing to appoint a neutral engineer and accept his report, sharing his SAR 600 fee. The engineer compares the move-in report photos with the apartment’s condition, confirms the broken door and burned worktop as damage from abnormal use, and classes the faded paint after three years as normal wear. Only SAR 3,500 is deducted and SAR 1,500 is returned to the tenant — with no lawsuit needed.

Common Mistakes

  • ✗Not documenting the unit’s condition at move-in with a report and dated photos — it then becomes hard to prove the damage occurred during the tenancy.
  • ✗Charging the tenant for normal wear such as faded paint or natural floor wear — the tenant is not liable for what ordinary use entails.
  • ✗Pricing at brand-new replacement cost instead of reasonable repair cost — compensation restores the previous position; it does not enrich.
  • ✗Keeping the entire deposit without an itemised statement and invoices — this invites a dispute and weakens the landlord’s position in court.
  • ✗Repairing damage before documenting it or before letting the other side inspect — the evidence is lost; where there is a risk, an urgent claim to record the state of affairs is available.

International Differences

In the United Kingdom, residential deposits are held in approved protection schemes that offer free adjudication of deduction disputes, with heavy reliance on the check-in inventory. In Turkey, the security deposit on residential leases may not exceed three months’ rent. In Dubai, deposit disputes go to the Rental Disputes Settlement Centre. Saudi Arabia has no standalone deposit-protection scheme, so disputes rely on the lease terms, good documentation and expert evidence under the Law of Evidence.

FAQs

What is the difference between damage and normal wear and tear?▾
Normal wear is the natural effect of ordinary use over time, such as faded paint, and the tenant is not liable for it. Damage results from the tenant’s transgression or negligence, such as breakage or burns, and he must compensate it (Articles 430 and 435 of the Civil Transactions Law).
Who assesses damage when the parties disagree?▾
The parties can agree on a neutral expert and may agree in advance to accept his findings. Otherwise the court appoints an expert on technical matters under the Law of Evidence, and the losing party bears the expert’s fees.
Can the landlord deduct damage directly from the deposit?▾
This depends on the lease terms and the parties’ agreement, supported by an itemised statement of the damage, its value and documents. If the tenant objects, the competent court decides — or an arbitral tribunal if there is an arbitration agreement.
How should I document a unit’s condition to avoid disputes?▾
With a signed move-in and move-out report including dated photos of every room, the state of appliances and meter readings; the Law of Evidence treats digital evidence as writing, and an urgent claim to record the state of affairs is available if a dispute arises.
Does the valuer need to be accredited?▾
The Saudi Authority for Accredited Valuers (Taqeem) regulates the valuation profession. Using an accredited valuer for property values, or a specialist engineer for technical faults, makes the report stronger before a court.
