Overview
A building code is the set of mandatory technical requirements governing the design, construction, operation, maintenance and alteration of buildings to ensure safety and public health. In Saudi Arabia it is the Saudi Building Code (SBC), which the law defines as the set of requirements, with their implementing regulations and annexes, relating to building and construction.
The Saudi Building Code Implementation Law was issued by Royal Decree No. (M/43) dated 26/4/1438H, published on 21/3/1440H and brought into force one year after publication. It was amended by Royal Decree (M/15) dated 19/1/1441H, which added the joint liability of the supervising designer and the contractor; by (M/88) dated 10/4/1446H, which made the occupancy certificate a basic condition for full energization of electricity; and by (M/204) dated 12/9/1446H, which replaced the National Committee with the Saudi Building Code Center. The code applies to all building works in the public and private sectors, applying any other code is prohibited, and it is updated every five years. The 2024 edition includes, among others: general (SBC 201), structural (SBC 301–313), electrical (401), mechanical (501), energy conservation (601/602), plumbing and private sewage (701/702), fire protection (801), existing and historical buildings (901/902), green (1001), residential (1101/1102), fuel gas (1201) and swimming pools (1401).
In practice, code compliance is a condition for building, restoration and change-of-use permits, is checked through stage inspections before the occupancy certificate, and violations carry fines of up to SAR 1 million per violation per building. For buyers and investors, the code provides a single benchmark to refer to when checking build quality or claiming defects.
⚖️ Legal Basis
Saudi Building Code Implementation Law issued by Royal Decree No. (M/43) dated 26/4/1438H, as amended by Royal Decrees (M/15) dated 19/1/1441H, (M/88) dated 10/4/1446H and (M/204) dated 12/9/1446H: Art. 1 (definition of the code), Art. 2 (application to the public and private sectors and prohibition of any other code), Art. 5 (update every five years), Art. 6 (code compliance as a permit condition), Art. 9 (occupancy certificate) and Art. 12 (penalties). Implementing Regulation of the Law issued by Ministerial Decision No. (1213/Q/A'/39) dated 14/10/1439H and its amendments, including Art. 29 (ten-year liability).
💡 Practical Example
An owner is building a four-storey residential block in Riyadh for SAR 5,200,000. The engineering office designed it to the general code SBC 201, the structural codes and the fire protection code, and inspections took place at the foundation, frame and services stages. At the frame stage the inspector found that one slab's reinforcement was below the approved drawings, so work on that part was halted until corrected at a cost of SAR 38,000 borne by the contractor. After completion, approval of the final inspection and the as-built drawings, the occupancy certificate was issued, full electricity was connected and the owner started leasing.
⚠️ Common Mistakes
- ✗Believing the code is optional technical guidance, whereas it is mandatory by law with fines of up to SAR 1 million per violation.
- ✗Using old or copied drawings that do not reflect the edition of the code in force.
- ✗Applying a foreign code instead of the Saudi code, which is prohibited since the law came into force.
- ✗Ignoring that later alteration or change of use brings the building under the code's requirements again.
- ✗Neglecting stage inspections, which makes discovering violations late and costly.
🌍 International Differences
Many codes worldwide are based on the US International Code Council (ICC) codes, including large parts of the Saudi code after adaptation to local conditions. In the UAE, Dubai has issued a unified building code and Abu Dhabi uses adapted international codes; Turkey applies the 2018 Building Earthquake Regulation alongside planning regulations; Egypt applies the Egyptian codes issued by the Housing and Building National Research Center; and the UK uses the Building Regulations. The Saudi code stands out for having its own law setting penalties, the developing body and a five-year update cycle.
