Overview
Legal Basis
Tenant rights are based on the Civil Transactions Law issued by Royal Decree No. (M/191) of 1444 AH, especially the chapter related to rental, and the Ejar platform regulations issued by the General Authority for Real Estate (REGA). These rights are also strengthened by the Enforcement Law issued by Royal Decree No. (M/53) of 1433 AH which allows effective protection from arbitrary actions. If the owner violates any of these rights, the tenant has the right to file a complaint with REGA or file a lawsuit before the Judicial Committee for Rental Disputes.
Practical Example
Hind, a tenant of an apartment in Riyadh with annual rent of SAR 36,000, received the property with an electrical defect (old broken electrical panel). She informed the owner twice within a month, but he procrastinated then refused repair on the pretext that maintenance is on the tenant. Hind logs into Ejar and files a complaint supported by photos and communication history. The mediation service intervenes and reminds the owner that structural maintenance and basic electrical systems are on the owner. The panel is repaired within a week. Or in another case: an owner tries to raise the rent 30% upon renewal after a year. Hind relies on a rental contract specifying the increase mechanism (5% only), and can refuse the excessive increase and continue the contract with the same terms. Upon owner insistence, it is referred to the Judicial Committee and she gets a ruling preserving the original terms.
Common Mistakes
- ✗Vacating the property without legal notice to the owner — the tenant loses the deposit and may be obligated to remaining rents.
- ✗Assuming maintenance of everything in the property is on the tenant — structural maintenance and basic systems are generally on the owner.
- ✗Accepting owner visit without prior notice — this is a tenant right and they may refuse surprise visits.
- ✗Not documenting the property condition upon receipt — causes end-of-term disputes over damages.
- ✗Overlooking the rent increase clause in the contract — there may be a clause allowing annual increase that was not noticed.
International Differences
Tenant rights protection differs between countries. In the UAE, the Rental Law in each emirate (especially Dubai and Abu Dhabi) provides comprehensive protection with specialized committees. In Turkey, the Turkish Code of Obligations gives the tenant strong protection, especially in long-term contracts. In Egypt, the Old Rental Law (for those who rented before 1996) gives the tenant excessive protection, while the new one is more balanced. In the UK, Housing Act 1988 onwards clearly defines tenant rights, especially Assured Shorthold Tenancy. In the US, laws differ between states (New York is strict in favor of the tenant, Texas is balanced). The Saudi advantage in tenant rights is speed in protection (Ejar procedures within days), electronic integration, and direct enforcement mechanism without lengthy litigation.
