Legal Basis
Residential lease is governed by the Civil Transactions Law issued by Royal Decree No. (M/191) of 1444 AH and the Ejar Platform Regulation under the General Authority for Real Estate. VAT exemption on residential rent was issued by Zakat, Tax and Customs Authority decision in 2024, based on the VAT executive regulation.
Practical Example
A Saudi family relocates from Dammam to Riyadh. They lease a villa for SAR 80,000 annually. When documenting the contract in Ejar: 'Residential' is selected as type, automatically exempting from VAT (15% = SAR 12,000 saved). Purpose is 'private residence' only, and the contract obligates the lessor for major maintenance. If the lessee tries to convert part of the villa into a commercial office, it's a contract breach. If the lessor later sells the villa to a new owner, the residential contract remains effective and binds the new owner to honor it until period end, protecting the family's housing stability.
Common Mistakes
- ✗Using residential contract for commercial purposes (office, clinic) — a contract breach exposing the lessee to eviction.
- ✗Agreeing on short-term furnished rental with a regular residential contract instead of correct classification — may create tax issues.
- ✗Failing to document essential residential fixtures in the contract (AC, water heater, equipped kitchen) — later difficult to claim repairs.
- ✗Assuming the residential contract applies to serviced apartments — this is a separate category with different provisions.
- ✗Subletting to change purpose (residential to office) — a clear violation and may void the contract judicially.
International Differences
In the UAE, residential contracts are governed by Law No. 26 of 2007 and are not subject to VAT. In Turkey, residential tenant protection is very strong (eviction is difficult). In Egypt, the old rent law protects the tenant unprecedentedly (inheritance to children). The Saudi advantage: balance between residential tenant protection and owner rights, with rapid digital enforcement.
